In addition to whatever remedies are available under the\n\ncommon or statutory law of this state, failure to comply with the\n\nrequirements of this act shall:\n\n1. Provide a basis for a civil malpractice action for actual\n\nand punitive damages;\n\n2. Provide a basis for a professional disciplinary action; and\n\n3. Provide a basis for recovery for the woman's survivors for\n\nthe wrongful death of the woman.\n\nB. When requested, the court shall allow a woman to proceed\n\nusing solely her initials or a pseudonym and may close any\n\nproceedings in the case and enter other protective orders to\n\npreserve the privacy of the woman upon whom the drug-induced\n\nabortion was attempted, induced or performed.\n\nC. If judgment is rendered in favor of the plaintiff, the court\n\nshall also render judgment for reasonable attorney fees in favor of\n\nthe plaintiff against the defendant.\n\nD. If judgment is rendered in favor of the defendant and the\n\ncourt finds that the plaintiff's suit was frivolous and brought in\n\nbad faith, the court may render judgment for reasonable attorney\n\nfees in favor of the defendant against the plaintiff.\n\nE. A cause of action for injunctive relief against a person who\n\nhas provided an abortion-inducing drug in violation of this act may\n\nbe maintained by:\n\n1. A woman to whom such an abortion-inducing drug was provided;\n\n2. A person who is the spouse, parent or guardian of, or a\n\ncurrent or former licensed health care provider of, a woman to whom\n\nsuch an abortion-inducing drug was provided; or\n\n3.
