Stat. tit. 63, § 63-1-757.2","heading":"Definitions","body":"\n\nAs used in this act:\n\n1. \"Abortion\" means the act of using or prescribing any\n\ninstrument, medicine, drug or any other substance, device or means\n\nwith the intent to terminate the pregnancy of a woman known to be\n\npregnant, with knowledge that the termination by those means will\n\nwith reasonable likelihood cause the death of the unborn child.\n\nSuch use, prescription or means is not an abortion if done with the\n\nintent to:\n\na. save the life or preserve the health of the unborn\n\nchild,\n\nb. remove a dead unborn child caused by spontaneous\n\nabortion, accidental trauma or a criminal assault on\n\nthe pregnant woman or her unborn child,\n\nc. remove an ectopic pregnancy, or\n\nd. treat a maternal disease or illness for which the\n\nprescribed drug is indicated;\n\n2. \"Abortion-inducing drug\" means a medicine, drug or any other\n\nsubstance prescribed or dispensed with the intent of terminating the\n\npregnancy of a woman known to be pregnant, with knowledge that the\n\ntermination will with reasonable likelihood cause the death of the\n\nunborn child. This includes the off-label use of drugs known to\n\nhave abortion-inducing properties, which are prescribed specifically\n\nwith the intent of causing an abortion, such as mifepristone\n\n(Mifeprex), misoprostol (Cytotec) and methotrexate. This definition\n\ndoes not apply to drugs that may be known to cause an abortion, but\n\nwhich are prescribed for other medical indications, such as\n\nchemotherapeutic agents and diagnostic drugs. The use of such drugs\n\nto induce abortion is also known as \"medical\", \"medication\", \"RU–\n\n486\", \"chemical\", \"Mifeprex regimen\" or \"drug-induced\" abortion;\n\n3. \"Adverse event\", according to the Food and Drug\n\nAdministration, means any untoward medical occurrence associated\n\nwith the use of a drug in humans, whether or not considered drug-\n\nrelated. It does not include an adverse event or suspected adverse\n\nreaction that, had it occurred in a more severe form, might have\n\ncaused death;\n\n4. \"Associated physician\" means a person fully licensed and in\n\ngood standing to practice medicine in the state including medical\n\ndoctors and doctors of osteopathy, who has entered into an\n\nassociated physician agreement;\n\n5. \"Complication\" means any adverse physical or psychological\n\ncondition arising from the performance of an abortion which\n\nincludes, but is not limited to, uterine perforation, cervical\n\nperforation, infection, heavy or uncontrolled bleeding, hemorrhage,\n\nblood clots resulting in pulmonary embolism or deep vein thrombosis,\n\nfailure to actually terminate the pregnancy, incomplete abortion\n\n(retained tissue), pelvic inflammatory disease, endometritis, missed\n\nectopic pregnancy, cardiac arrest, respiratory arrest, renal\n\nfailure, metabolic disorder, shock, embolism, coma, placenta previa\n\nin subsequent pregnancies, preterm delivery in subsequent\n\npregnancies, free fluid in the abdomen, hemolytic reaction due to\n\nthe administration of ABO-incompatible blood or blood products,\n\nadverse reactions to anesthesia and other drugs, subsequent\n\ndevelopment of breast cancer, psychological complications such as\n\ndepression, suicidal ideation, anxiety, sleeping disorders, death\n\nand any other adverse event as defined by the Food and Drug\n\nAdministration criteria provided in the Medwatch Reporting System;\n\n6. \"Gestational age\" means the time that has elapsed since the\n\nfirst day of the woman's last menstrual period, also known as \"last\n\nmenstrual period\" or \"LMP\";\n\n7. \"Hospital\" means an institution providing medical and\n\nsurgical treatment and nursing care for sick or injured people, or\n\ninstitutions defined under Section 1-701 of Title 63 of the Oklahoma\n\nStatutes;\n\n8. \"Manufacturers and distributors\" means individuals or\n\nentities that create, produce, supply, transport or sell drugs,\n\nwhich include:\n\na. any substances recognized by an official pharmacopoeia\n\"Hospital\" means an institution providing medical and\n\nsurgical treatment and nursing care for sick or injured people, or\n\ninstitutions defined under Section 1-701 of Title 63 of the Oklahoma\n\nStatutes;\n\n8. \"Manufacturers and distributors\" means individuals or\n\nentities that create, produce, supply, transport or sell drugs,\n\nwhich include:\n\na. any substances recognized by an official pharmacopoeia\n\nor formulary,\n\nb. any substances intended for use in the diagnosis,\n\ncure, mitigation, treatment or prevention of disease,\n\nc. any substances other than food intended to affect the\n\nstructure or any function of the body, or\n\nd. any substances intended for use as a component of a\n\nmedicine but not a device or a component, part or\n\naccessory of a device;\n\n9. \"Obstetrician/gynecologist\", also known as OB/GYN, means a\n\nlicensed physician who specializes in the care of women during\n\npregnancy and childbirth and in the diagnosis and treatment of\n\ndiseases of the female reproductive organs and specializes in other\n\nwomen's health issues such as menopause, hormone problems,\n\ncontraception or birth control, and infertility;\n\n10. \"Physician\" means any person fully licensed by and in good\n\nstanding with the State Board of Medical Licensure and Supervision\n\nor the State Board of Osteopathic Examiners to practice medicine in\n\nthis state. The term includes medical doctors and doctors of\n\nosteopathy;\n\n11. \"Pregnant\" or \"pregnancy\" means that female reproductive\n\ncondition of having an unborn child in the mother's uterus;\n\n12. \"Provide\" or \"provision\" means, when used regarding\n\nabortion-inducing drugs, any act of giving, selling, dispensing,\n\nadministering, transferring possession to or otherwise providing or\n\nprescribing an abortion-inducing drug; and\n\n13. \"Unborn child\" means an individual organism of the species\n\nHomo sapiens, beginning at fertilization, until the point of being\n\nborn-alive as defined in Title 1 U.S.C., Section 8(b).","path":["OK Code","Title 63"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os63.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"3c815eca16f0ba007ada4b34a3e803995344a7b31d5e52857354b795e69f6bd6","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-63-63-1-757.16","next":"us-ok/okla.-stat.-tit.-63-63-1-757.3"},"notice":"GroundRules: Original legal text.
