Stat. tit. 63, § 63-1-820","heading":"Definitions","body":"As used in the Residential Care Act:\n\n1. \"Abuse\" means the willful infliction of injury, unreasonable\n\nconfinement, intimidation or punishment, with resulting physical\n\nharm, impairment or mental anguish;\n\n2. \"Access\" means the right of a person to enter a home to\n\ncommunicate privately and without unreasonable restriction;\n\n3. \"Administrator\" means the person who is in charge of a home\n\nand who devotes at least one-third (1/3) of his or her full working\n\ntime to on-the-job supervision of the home;\n\n4. \"Adult companion home\" means any home or establishment,\n\nfunded and certified by the Department of Human Services, which\n\nprovides homelike residential accommodations and supportive\n\nassistance to three or fewer developmentally disabled adults;\n\n5. \"Advisory Board\" means the Long-Term Care Facility Advisory\n\nBoard;\n\n6. \"Ambulatory\" means any resident who is capable of self-\n\nmovement, including in and out of wheelchairs, to all areas of the\n\nhome;\n\n7. \"Board\" means the State Board of Health;\n\n8. \"Commissioner\" means the State Commissioner of Health;\n\n9. \"Department\" means the State Department of Health;\n\n10. \"Habilitation\" means procedures and interventions designed\n\nto assist a mentally ill, drug-dependent or alcohol-dependent person\n\neighteen (18) years of age or older to achieve greater physical,\n\nmental and social development by enhancing the well-being of the\n\nperson and teaching skills which increase the possibility that the\n\nresident will make progressively independent and responsible\n\ndecisions about social behavior, quality of life, job satisfaction\n\nand personal relationships;\n\n11. \"Home\" means a residential care home;\n\n12. \"Residential care home\":\n\na. means any establishment or institution which offers,\n\nprovides or supports residential accommodations, food\n\nservice, and supportive assistance to any of its\n\nresidents or houses any residents requiring supportive\n\nassistance who are not related to the owner or\n\nadministrator of the home by blood or marriage. A\n\nresidential care home shall not include:\n\n(1) an adult companion home,\n\n(2) a group home,\n\n(3) a hotel,\n\n(4) a motel,\n\n(5) a residential mental health facility operated by\n\nthe Department of Mental Health and Substance\n\nAbuse Services,\n\n(6) a fraternity or a sorority house,\n\n(7) college or university dormitory, or\n\n(8) a home or facility approved and annually reviewed\n\nby the United States Department of Veterans\n\nAffairs as a medical foster home in which care is\n\nprovided exclusively to three or fewer veterans.\n\nThe residents of a residential care home shall be\n\nambulatory and essentially capable of participating in\n\ntheir own activities of daily living, but shall not\n\nroutinely require nursing services, and\n\nb. may consist of a series of units or buildings which\n\nare not connected or part of the same structure if:\n\n(1) such buildings or units are owned by the same\n\nowner or operator,\n\n(2) all residents of the units or buildings are fully\n\ncapable of ambulation to and from the buildings\n\nor units,\n\n(3) the location and construction of the buildings or\n\nunits ensure the health, safety, and protection\n\nfrom fire hazards and other hazards and provide\n\nfor the convenience and accessibility of the\n\nresidents to each residential building or unit,\n\n(4) any out-of-doors premise or thoroughfare is\n\nadequately maintained to ensure the health and\n\nsafety of the residents, and\nhe buildings or\n\nunits ensure the health, safety, and protection\n\nfrom fire hazards and other hazards and provide\n\nfor the convenience and accessibility of the\n\nresidents to each residential building or unit,\n\n(4) any out-of-doors premise or thoroughfare is\n\nadequately maintained to ensure the health and\n\nsafety of the residents, and\n\n(5) the buildings or units are within one hundred\n\nseventy-five (175) feet of the building housing\n\nthe main kitchen and dining room. The units or\n\nbuildings must be located in the most convenient\n\nand accessible location for residents;\n\nprovided, however, the leasing of rooms directly or\n\nindirectly to residents of a home shall not void the\n\napplication of the provisions of the Residential Care\n\nAct or rules promulgated pursuant thereto.\n\nThe State Board of Health shall promulgate rules for such\n\nresidential homes pursuant to the provisions of Section 1-836 of\n\nthis title;\n\n13. \"Licensee\" means a person, corporation, partnership, or\n\nassociation who is the owner of a home which is licensed pursuant to\n\nthe provisions of the Residential Care Act;\n\n14. \"Maintenance\" means meals, shelter, and laundry services;\n\n15. \"Neglect\" means failure to provide goods and/or services\n\nnecessary to avoid physical harm, mental anguish, or mental illness;\n\n16. \"Operator\" means the person who is not the administrator\n\nbut who manages the home;\n\n17. \"Owner\" means a person, corporation, partnership,\n\nassociation, or other entity which owns or leases a home or part of\n\na home, directly or indirectly, to residents. The person or entity\n\nthat stands to profit or lose as a result of the financial success\n\nor failure of the operation shall be presumed to be the owner of the\n\nhome;\n\n18. \"Personal care\" means assistance with meals, dressing,\n\nmovement, bathing or other personal needs or maintenance, or general\n\nsupervision of the physical and mental well-being of a person, who\n\nis incapable of maintaining a private, independent residence, or who\n\nis unable to manage all activities of daily living without\n\nassistance, whether or not a guardian has been appointed for the\n\nperson;\n\n19. \"Resident\" means a person of legal age, residing in a home\n\ndue to illness, physical or mental infirmity, or advanced age;\n\n20. \"Representative of a resident\" means a court-appointed\n\nguardian, or if there is no court-appointed guardian, a relative or\n\nother person designated in writing by the resident. No owner,\n\nagent, employee, or person with a pecuniary interest in the\n\nresidential facility or relative thereof shall be a representative\n\nof a resident unless the person is appointed by the court;\n\n21. \"Supportive assistance\" means the service rendered to any\n\nperson which is sufficient to enable the person to meet an adequate\n\nlevel of daily living. Supportive assistance includes, but is not\n\nlimited to, housekeeping, assistance in the preparation of meals,\n\nassistance in the safe storage, distribution and administration of\n\nmedications, and assistance in personal care as necessary for the\n\nhealth and comfort of the person. The term \"supportive assistance\"\n\nshall not be interpreted or applied so as to prohibit the\n\nparticipation of residents in housekeeping or meal preparation tasks\n\nas a part of the written treatment plan for the training,\n\nhabilitation or rehabilitation of the resident, prepared with the\n\nparticipation of the resident, the mental health or drug or alcohol\n\nservices case manager assigned to the resident, and the\n\nadministrator of the facility or a designee; and\n\n22. \"Transfer\" means a change in location of living\n\narrangements of a resident from one home to another home.","path":["OK Code","Title 63"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os63.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"97a9a33fea2d502f403f58657bcc56c28ffba085df166d87442d0f9b236befa8","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-63-63-1-819","next":"us-ok/okla.-stat.-tit.-63-63-1-821"},"notice":"GroundRules: Original legal text.
