Stat. tit. 63, § 63-1-822","heading":"Application for license - Fee - Information required -","body":"Qualifications - Issuance of license - Expiration - Modification -\n\nRenewal.\n\nA. An application for a license, or renewal thereof, to\n\nestablish or operate a residential care home shall be accompanied by\n\na fee of Fifty Dollars ($50.00) for the probationary license and\n\nTwenty-five Dollars ($25.00) per year for the renewal license. The\n\nfee shall not be refunded. Except as provided for in Section 1-824\n\nof this title, a license shall expire thirty-six (36) months from\n\nthe date of issuance, unless sooner revoked, and may be renewed by\n\nthe State Department of Health pursuant to the provisions of the\n\nResidential Care Act. Renewal licenses may be issued for a period\n\nof more than twenty-four (24) months, but not more than thirty-six\n\n(36) months, for the license period immediately following November\n\n1, 2021, in order to permit an equitable distribution of license\n\nexpiration dates. All licenses shall be on a form prescribed by the\n\nState Commissioner of Health, and shall include, but not be limited\n\nto, the maximum bed capacity for which the license is granted, the\n\ndate the license was issued, and the expiration date of the license.\n\nThe provisions of the license shall require that the license shall:\n\n1. Not be transferable or assignable except as authorized by\n\nthe provisions of the Residential Care Act;\n\n2. Be posted in a conspicuous place on the licensed premises;\n\nand\n\n3. Be issued only for the premises named in the application and\n\nmay be renewed upon application, inspection and payment of the\n\nlicense fee, as required by the provisions of the Residential Care\n\nAct.\n\nB. An application shall contain the following information:\n\n1. The name and address of the owner of the home. If the owner\n\nis a firm or partnership, the name and address of each member\n\nthereof shall be included in the application. If the owner is a\n\ncorporation, the name and address of the corporation and the name\n\nand address of each officer and registered agent of the corporation\n\nshall be included in the application;\n\n2. The name and address of the applicant if the applicant is\n\nnot the owner and is acting as agent for the owner;\n\n3. The name and location of the home for which a license is\n\nsought;\n\n4. The name of the administrator of the home;\n\n5. The number and type of residents for whom services are to be\n\nprovided; and\n\n6. The staffing pattern for providing resident care. In the\n\ncase of an application for an initial license, the staffing pattern\n\nshown may be the projected staffing pattern.\n\nC. Each initial application shall be accompanied by a statement\n\nfrom the unit of local government having zoning jurisdiction over\n\nthe location of the home stating that the location is not in\n\nviolation of a zoning ordinance.\n\nD. 1. An applicant shall be twenty-one (21) years of age or\n\nolder and meet the specific requirements for licensure as specified\n\nin rules promulgated by the State Commissioner of Health pursuant to\n\nthe provisions of the Residential Care Act.\n\n2. No person who has been convicted of a felony in connection\n\nwith the management or operation of a home, or facility as defined\n\nin Section 1-1902 of this title or in the care and treatment of the\n\nresidents of a home, or facility as defined in Section 1-1902 or 1-\n\n1950.1 of this title shall be eligible to be licensed or to\n\nparticipate in the management or operation of a home.\n\n3. If the applicant is a firm, partnership, or corporation, the\n\napplicant shall not be eligible to be licensed if any member of the\n\nfirm or partnership or any officer or major stockholder of the\n\ncorporation has been convicted of a felony in connection with the\n\noperation or management of a home or facility or the care and\n\ntreatment of the residents of a home or facility as defined in\n\nSection 1-1902 of this title.\n\nE. 1. The application for a license or renewal of a license\n\nshall be accompanied by a statement of ownership which shall include\np or any officer or major stockholder of the\n\ncorporation has been convicted of a felony in connection with the\n\noperation or management of a home or facility or the care and\n\ntreatment of the residents of a home or facility as defined in\n\nSection 1-1902 of this title.\n\nE. 1. The application for a license or renewal of a license\n\nshall be accompanied by a statement of ownership which shall include\n\nthe following:\n\na. the name, address, telephone number, occupation or\n\nbusiness activity, business address, and business\n\ntelephone number of the owner of the home and of every\n\nperson who owns the building in which the home is\n\nlocated. If the owner is a partnership or\n\ncorporation, the name and address of each partner and\n\nstockholder with an ownership interest of five percent\n\n(5%) or more shall be included in the statement, and\n\nb. the name and address of any other home in which the\n\nowner has a full or partial financial interest or, if\n\nthe owner is a partnership or corporation, any other\n\nhome in which the partnership or corporation has a\n\nfull or partial financial interest. The statement\n\nshall indicate whether or not any other home wherein a\n\nfull or partial financial interest is held would, if\n\nlocated in this state, be required to be licensed.\n\n2. The applicant shall agree in writing, prior to the issuance\n\nof a license, to notify the Department if there is any change in the\n\ninformation required to be included in the statement of ownership\n\nthirty (30) days in advance of such change. The information\n\ncontained in the statement of ownership shall be public information\n\nand shall be available upon request from the Department.\n\nF. Upon application of a licensee, a license may be modified in\n\naccordance with the provisions of the Residential Care Act. Such\n\napplication for modification of a license shall be accompanied by a\n\nfee of Twenty Dollars ($20.00) and shall be submitted in such form\n\nand manner as required by the Department.\n\nG. Upon payment of the required application fees, the\n\nCommissioner may issue and renew licenses which substantially comply\n\nwith the provisions of the Residential Care Act and rules\n\npromulgated pursuant thereto; provided, however, a plan of\n\ncorrection shall be submitted and accepted by both parties prior to\n\nlicensure.\n\nH.
