Stat. tit. 63, § 63-1-824","heading":"Probationary license - Duration - Conditions for","body":"issuance - Termination - Issuance or denial of regular license.\n\nIf an applicant for licensure under the Residential Care Act has\n\nnot been previously licensed, or if a home is not in operation at\n\nthe time application is made, the State Department of Health shall\n\nissue a probationary license. A probationary license shall be valid\n\nfor one hundred twenty (120) days unless sooner suspended or revoked\n\npursuant to the provisions of the Residential Care Act.\n\n1. Prior to the issuance of a probationary license, the\n\nDepartment shall:\n\na. ascertain whether the applicant is qualified to be\n\nlicensed pursuant to the provisions of Section 1-822\n\nof this title, and\n\nb. inspect the home and inform the applicant of any\n\nconditions which require correction prior to the\n\nissuance of a license. If the home is a new home, the\n\nDepartment shall also inform the applicant of any\n\ncondition which requires correction prior to the\n\nacceptance of residents into the home. If the home is\n\nan existing home whose ownership is being transferred,\n\nthe probationary license issued to the transferee, in\n\naddition to any corrections required as a result of\n\nthe inspection, shall be subject to any plan of\n\ncorrection submitted by the previous owner and\n\napproved by the Department.\n\n2. Within thirty (30) days prior to the termination of a\n\nprobationary license, the Department shall completely inspect the\n\nhome and, if the home meets the applicable rules for licensure,\n\nshall issue a license pursuant to the provisions of the Residential\n\nCare Act and rules promulgated pursuant thereto. If at the end of\n\nan extension of the probationary license, the home is not in\n\nsubstantial compliance with the provisions of the Residential Care\n\nAct and the rules promulgated pursuant thereto, the license shall be\n\ndenied and the Department shall take such action as necessary and as\n\nauthorized pursuant to the provisions of the Residential Care Act\n\nfor the protection of the health, safety, and welfare of the\n\nresidents of the home.","path":["OK Code","Title 63"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os63.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"f55b1f8408999a3fed0b31b9803ef431a412215b0a19e22cde8554910c46a7ff","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-63-63-1-823","next":"us-ok/okla.-stat.-tit.-63-63-1-825"},"notice":"GroundRules: Original legal text.
