Stat. tit. 63, § 63-1-826","heading":"Denial, refusal to renew, suspension or revocation of","body":"license.\n\nAfter notice and opportunity for hearing pursuant to the\n\nprovisions of Section 1-830 of this title, the State Department of\n\nHealth may:\n\n1. Deny a license to an applicant who does not meet the\n\nrequirements for licensure pursuant to the provisions of the\n\nResidential Care Act or rules promulgated pursuant thereto;\n\n2. Refuse to renew, suspend, or revoke a license to a licensee\n\nor home which is not in compliance with the provisions of the\n\nResidential Care Act or the rules of the State Board of Health\n\npromulgated pursuant thereto;\n\n3. Deny, refuse to renew, suspend, or revoke a license to an\n\napplicant, licensee, or home which has a history of noncompliance or\n\nincomplete or partial compliance with the provisions of the\n\nResidential Care Act or the rules promulgated pursuant thereto or\n\nfor which there is other satisfactory evidence which demonstrates\n\nthat the applicant or licensee is unlikely to manage or operate a\n\nhome or to provide care or treatment to the residents of a home in a\n\nmanner which warrants public trust;\n\n4. Deny, refuse to renew, suspend, or revoke a license to an\n\napplicant or licensee who has insufficient financial or other\n\nresources to the extent that the applicant or licensee is incapable\n\nof assuring or providing adequate care or treatment to the residents\n\nof the home;\n\n5. Deny, refuse to renew, suspend, or revoke a license to an\n\napplicant or licensee who has been convicted of a felony in\n\nconnection with the management or operation of a home, or facility\n\nas defined in Section 1-1902 of this title, or the care or treatment\n\nof a resident of the home, or facility as defined in Section 1-1902\n\nof this title;\n\n6. Deny, refuse to renew, suspend, or revoke a license if an\n\nadministrator or operator of a home has been convicted of a felony\n\nin connection with the management or operation of a home, or\n\nfacility as defined in Section 1-1902 or 1-1950.1 of this title, or\n\ncare or treatment of a resident of the home, or facility as defined\n\nin Section 1-1902 of this title;\n\n7. Deny, refuse to renew, suspend, or revoke a license to an\n\napplicant or licensee who has permitted, aided, or abetted the\n\ncommission of any illegal act in connection with the management or\n\noperation of a home or the care or treatment of a resident of a\n\nhome;\n\n8. Refuse to renew a license if, at the time application is\n\nmade for the renewal of the license, the licensee or home is subject\n\nto a plan of correction. The license may be renewed at such time as\n\nthe required corrections are completed in the manner and time\n\nspecified in the plan of correction. If a license is issued or\n\nrenewed with a plan of correction, such license may be suspended if\n\nthe required corrections are not completed in the manner and time\n\nspecified in the plan of correction; or\n\n9.
