No person shall willfully:\n\n1. Fail to correct or interfere with the correction of a\n\nviolation within the time specified on the notice or approved plan\n\nof correction pursuant to the provisions of the Residential Care Act\n\nas the maximum period given for correction, unless an extension is\n\ngranted and the corrections are made before expiration of extension;\n\n2. Prevent, interfere with, or attempt to impede in any way the\n\nwork of any duly authorized representative of the State Department\n\nof Health in the investigation and enforcement of the Residential\n\nCare Act;\n\n3. Prevent or attempt to prevent any such representative from\n\nexamining any relevant books or records in the conduct of official\n\nduties pursuant to the provisions of the Residential Care Act;\n\n4. Prevent or interfere with any such representative in the\n\npreserving of evidence of any violation of the Residential Care Act\n\nor the rules promulgated pursuant thereto;\n\n5. Retaliate or discriminate against any resident or employee\n\nfor contacting or providing information to any state official, or\n\nfor initiating, participating in, or testifying in an action for any\n\nremedy authorized pursuant to the provisions of the Residential Care\n\nAct;\n\n6. File any false, incomplete, or intentionally misleading\n\ninformation required to be filed pursuant to the provisions of the\n\nResidential Care Act, or willfully fail or refuse to file any\n\ninformation required by the Department pursuant to the provisions of\n\nthe Residential Care Act; or\n\n7. Open or operate a home without a license. Operation of a\n\nresidential care home without a license is a public health emergency\n\nwarranting action pursuant to the provisions of Section 1-830 of\n\nthis title.\n\nB. No employee of a state or unit of a local governmental\n\nagency shall aid, abet, assist, conceal or conspire with an\n\nadministrator, operator or other employee of a home in a violation\n\nof any provision of the Residential Care Act or any rule promulgated\n\nby the State Board of Health pursuant thereto.\n\nC. Any person who violates any of the provisions of the\n\nResidential Care Act, upon conviction, shall be guilty of a\n\nmisdemeanor.
