Any person who has been determined by the State Department\n\nof Health to have violated any provision of the Residential Care Act\n\nor any rule promulgated pursuant thereto may be liable for a civil\n\npenalty of not more than One Hundred Dollars ($100.00) for each day\n\nthat the violation continues. The maximum civil penalty shall not\n\nexceed Ten Thousand Dollars ($10,000.00) for any related series of\n\nviolations.\n\nB. The amount of the penalty shall be assessed by the\n\nDepartment pursuant to the provisions of subsection A of this\n\nsection, after notice and hearing. In determining the amount of the\n\npenalty, the Department shall include, but not be limited to,\n\nconsideration of the nature, circumstances, and gravity of the\n\nviolation and, with respect to the person found to have committed\n\nthe violation, the degree of culpability, the effect on ability of\n\nthe person to continue to do business, and any show of good faith in\n\nattempting to achieve compliance with the provisions of the\n\nResidential Care Act.\n\nC.
