The State Board of Health shall promulgate rules to enforce\n\nthe provisions of the Residential Care Act. Such rules shall\n\nregulate:\n\n1. Location and construction of the home, including plumbing,\n\nheating, lighting, ventilation, and other physical conditions which\n\nshall ensure the health, safety, and comfort of residents and\n\nprotection from fire hazards;\n\n2. Number of all personnel, including management and\n\nsupervisory personnel, having responsibility for any part of the\n\ncare given to residents. The Department shall establish staffing\n\nratios for homes which shall specify the number of staff hours of\n\ncare per resident that are needed for care for various types of\n\nhomes or areas within homes. Minimum personnel ratio requirements\n\nfor all homes shall be based only on average daily census;\n\n3. All sanitary conditions within the home and its\n\nsurroundings, including water supply, sewage disposal, food\n\nhandling, and general hygiene, which shall ensure the health and\n\ncomfort of residents;\n\n4. Diet-related needs of each resident based on sound\n\nnutritional practice and on recommendations which may be made by the\n\nphysicians attending the resident;\n\n5. Equipment essential to the health and welfare of the\n\nresidents; and\n\n6. Rehabilitation programs for those residents who would\n\nbenefit from such programs.\n\nB. 1. In order to further ensure minimum standards for homes,\n\na certificate of training as specified shall be required of all:\n\na. administrators, who shall obtain a residential care\n\nadministrator certificate of training, and\n\nb. direct care staff responsible for administration of\n\nmedication to residents, who shall obtain a\n\nresidential care certificate of training.\n\n2. The certificate will be developed and administered by an\n\ninstitution of higher learning with the advice of the State\n\nCommissioner of Health and of the Long-Term Care Facility Advisory\n\nBoard.\n\na. (1) For residential care home administrators the\n\ntraining shall consist of a minimum of fifty (50)\n\nhours which shall include at least fifteen (15)\n\nhours of training in the administration of\n\nmedication and shall also include, but not be\n\nlimited to, training in:\n\n(a) administration,\n\n(b) supervision,\n\n(c) reporting,\n\n(d) record keeping,\n\n(e) independent or daily living skills,\n\n(f) leisure skills and recreation, and\n\n(g) public relations concerning the issues\n\nassociated with the operation of residential\n\ncare homes and programs.\n\n(2) An individual applying for certification as an\n\nadministrator may at any time present the\n\ninstitution of higher education with\n\ndocumentation of prior education and work\n\nexperience for consideration for possible credit\n\ntoward certification.\n\n(3) Any person employed as an administrator after\n\nJuly 1, 1988, shall have completed the training\n\nspecified by this division.\n\n(4) Thereafter, annually, at least sixteen (16) hours\n\nof training in the subjects specified by this\n\ndivision shall be required for such\n\nadministrator.\ndocumentation of prior education and work\n\nexperience for consideration for possible credit\n\ntoward certification.\n\n(3) Any person employed as an administrator after\n\nJuly 1, 1988, shall have completed the training\n\nspecified by this division.\n\n(4) Thereafter, annually, at least sixteen (16) hours\n\nof training in the subjects specified by this\n\ndivision shall be required for such\n\nadministrator.\n\n(5) A certified administrator may make a written\n\nrequest to the Commissioner to be placed in an\n\ninactive status for up to five (5) subsequent\n\ncalendar years. Such inactive status shall allow\n\nthe administrator to waive the educational\n\nrequirements for the period of the request. Such\n\ncertified administrator shall not work in a\n\nresidential care administrator capacity in\n\nOklahoma until such time as the certificate is\n\nreactivated. The request to reactivate the\n\ncertificate shall be made in writing to the\n\nCommissioner. Such administrator shall then be\n\nrequired to complete sixteen (16) hours of\n\ntraining in the subjects specified in this\n\ndivision.\n\nb. All direct care staff who are responsible for\n\nadministration of medication to residents shall be\n\nrequired to begin training in the administration of\n\nmedication within ninety (90) days of employment with\n\nthe home and to satisfactorily complete at least\n\nfifteen (15) hours of training in the administration\n\nof medication, within the first year of employment\n\nwith the home.\n\n3. All other direct care staff who are employed by a\n\nresidential care home, within ninety (90) days of employment with\n\nthe home, shall be required to begin eight (8) hours of in-service\n\ntraining, to be administered by the administrator of the home or\n\nother person designated by the administrator of the home and\n\ncompleted within twelve (12) months from such person's date of\n\nemployment, and annually thereafter. Thereafter such direct care\n\nstaff and the direct care staff responsible for administering\n\nmedication to residents shall, annually, be required to receive at\n\nleast eight (8) hours of training by the administrator of the home\n\nin:\n\na. patient reporting and observation,\n\nb. record keeping,\n\nc. independent or daily living skills,\n\nd. leisure skills and recreation,\n\ne. human relations, and\n\nf. such other training relevant to residential care\n\nprograms and operations.\n\n4. The requirement of certification and the training specified\n\npursuant to the provisions of this subsection shall be included in\n\nthe rules promulgated by the Board.\n\n5. Failure of the owner or administrator to ensure the training\n\nrequired pursuant to this subsection is received shall constitute a\n\nviolation of the Residential Care Act and shall be grounds for\n\nrevocation of licensure. Proof of successful completion of such\n\ntraining for the residential care home administrator and direct care\n\nstaff shall be required prior to issuance or renewal of a license\n\nissued pursuant to the provisions of the Residential Care Act.
