The State Commissioner of Health shall have the power and\n\nduty to:\n\n1. Issue, renew, deny, modify, suspend and revoke certificates\n\nof need;\n\n2. Establish and enforce standards and requirements for\n\ncertificates of need;\n\n3. Require the submission of and to review reports from any\n\nperson requesting or obtaining a certificate of need;\n\n4. Employ or designate personnel necessary to implement the\n\nprovisions of the Long-term Care Certificate of Need Act;\n\n5. Report to the district attorney having jurisdiction or the\n\nAttorney General, any act committed by any person which may\n\nconstitute a violation pursuant to the provisions of the Long-term\n\nCare Certificate of Need Act;\n\n6. Advise, consult and cooperate with other agencies of this\n\nstate, the federal government, other states and interstate agencies,\n\nand with affected groups and political subdivisions to further the\n\npurposes of the provisions of the Long-term Care Certificate of Need\n\nAct;\n\n7. Promulgate and enforce rules subject to the approval of the\n\nState Board of Health to implement the provisions of the Long-term\n\nCare Certificate of Need Act;\n\n8. Investigate, request or otherwise obtain the information\n\nnecessary to determine the qualifications and background of an\n\napplicant for a certificate of need;\n\n9. Establish administrative penalties for violations of the\n\nprovisions of the Long-term Care Certificate of Need Act as\n\nauthorized by the Board;\n\n10. Institute and maintain or intervene in any action or\n\nproceeding where deemed necessary by the Department pursuant to the\n\nLong-term Care Certificate of Need Act;\n\n11. Develop and administer plans for health services including,\n\nbut not limited to, staffing, facilities and other resources;\n\n12. Develop and publish, once every four (4) years, a\n\nQuadrennial State Health Plan, following guidelines and procedures\n\nadopted by the Board which specify the method of adoption of the\n\nplan document, its format, provisions for developing and publishing\n\nplan amendments and the role of the State Department of Health,\n\nlocal health planning advisory councils and the Alcohol, Drug Abuse\n\nand Community Mental Health Planning and Coordination Boards of each\n\nmental health catchment area in its development;\n\n13. Establish and administer criteria and standards for the\n\ndelineation and approval of areas and regions for health planning\n\npurposes;\n\n14. Promote and maintain plans for providing health services\n\nincluding, but not limited to, health, staffing and health\n\nfacilities, in this state; and\n\n15. Exercise all incidental powers as necessary and proper for\n\nthe administration of the Long-term Care Certificate of Need Act.\n\nB. The State Department of Health shall be the single state\n\nagency to participate in federal programs for health planning and to\n\napply for and administer federal funds for health planning,\n\nprovided, that the Long-term Care Certificate of Need Act, and any\n\nother law vesting planning functions in any other state agency,\n\nshall not apply to health planning functions vested by law in the\n\nDepartment of Mental Health and Substance Abuse Services, the\n\nOklahoma Health Care Authority and the Department of Human Services.\n\nC.
