Stat. tit. 63, § 63-1-857","heading":"Time for submitting plans and specifications - Time for","body":"construction - Time for acquisition.\n\nA. 1. A certificate of need issued pursuant to the provisions\n\nof the Long-term Care Certificate of Need Act for the construction\n\nor establishment of a new long-term care service or the expansion of\n\nan existing service shall be valid for a period of six (6) months\n\nduring which time the applicant shall submit to the State Department\n\nof Health the plans and specifications for the facility to be\n\nconstructed; however, the Department may extend such time by a\n\nperiod not to exceed twelve (12) months for extraordinary\n\ncircumstances beyond the control of the applicant.\n\n2. If no such plans and specifications are submitted within the\n\ntime required by this section, then such certificate shall be null\n\nand void.\n\n3. If plans and specifications are submitted, the Department\n\nshall approve or disapprove such plans and specifications within\n\nthirty (30) days of the filing or such plans and specifications\n\nshall be presumed to be approved.\n\n4. If the Department disapproves the plans and specifications,\n\nsuch disapproval shall include a detailed statement of the\n\ncorrections needed.\n\n5. The State Board of Health shall provide by rule the review\n\nprocess and time deadlines not exceeding twelve (12) months for\n\napproval or disapproval and resubmittal of initial, final and\n\ncorrected plans and specifications. The applicant’s failure to meet\n\nthe review process deadlines promulgated by the Board shall render\n\nthe certificate of need void.\n\n6. The applicant must begin construction of the structure\n\nwithin twelve (12) months following the approval of the final plans\n\nand specifications and must proceed to complete the structure within\n\neighteen (18) months of the approval from the beginning of\n\nconstruction or the certificate will be canceled. However, the\n\nDepartment may extend such completion day by a period not to exceed\n\ntwenty-four (24) months for good cause upon the applicant’s\n\ndemonstration that the applicant has made a good faith effort to\n\ncomplete the structure or modifications and that the delay is\n\nunlikely to result in harm to the population to be served by the\n\napplicant.\n\nB. A certificate of need issued pursuant to the provisions of\n\nthis act for the acquisition of a long-term care facility shall be\n\nvalid for a period of six (6) months by which time the acquisition\n\nmust be finalized, provided that the Department may extend such\n\nfinal date by a period not to exceed twelve (12) months for good\n\ncause.\n\nC. Pending the appeal of an order granting a certificate of\n\nneed in the district or Supreme Court, the effective dates of\n\ndeadlines for submitting plans, filing reports, completion of the\n\nproject and other requirements related to such project shall\n\ncommence on the date of a final judicial determination of any such\n\nappeal, and any certificate of need which has been approved by the\n\nDepartment shall remain in effect pending such appeal. The\n\neffective date of the issuance of a certificate of need shall be the\n\ndate of a final judicial determination of any such appeal.
