Stat. tit. 63, § 63-1-857.6","heading":"Oklahoma Health Planning Commission - Abolition -","body":"Transfer of funds, property, etc.\n\nA. The Oklahoma Health Planning Commission is hereby abolished,\n\nand the powers, duties and responsibilities exercised by such\n\nCommission pursuant to law are hereby transferred to the State\n\nDepartment of Health and the State Commissioner of Health. All\n\nunexpended funds, property, records, personnel and any outstanding\n\nfinancial obligations and encumbrances of such office are hereby\n\ntransferred to the State Department of Health and the State\n\nCommissioner of Health.\n\nB. The Director of the Office of Management and Enterprise\n\nServices is hereby directed to coordinate the transfer of funds,\n\nallotments, purchase orders, outstanding financial obligations or\n\nencumbrances provided for in this section.\n\nC. Any application for a certificate of need which was duly\n\nfiled with the Oklahoma Health Planning Commission prior to the\n\neffective date of the Long-term Care Certificate of Need Act or the\n\nPsychiatric and Chemical Dependency Facility Certificate of Need Act\n\nshall be reviewed and approved or disapproved pursuant to criteria\n\nand procedures in effect at the time such application was filed.\n\nAny application for Certificate of Need not scheduled for review at\n\nthe regularly scheduled June, 1989, Commission meeting or by the\n\nDirector before July 1, 1989, shall be considered to have been duly\n\nfiled with the State Department of Health. In all appellate\n\nmatters, including but not limited to reconsideration and remand,\n\nthe Department shall be considered as the Commission.\n\nD. The rules of the Oklahoma Health Planning Commission in\n\neffect on July 1, 1989, shall be enforceable by the State Department\n\nof Health and shall remain effective until the adoption of new rules\n\nby the State Board of Health.\n\nE.
