Any person who offers or develops or begins to offer or\n\ndevelop a long-term care facility without having first obtained a\n\ncertificate of need, as provided by the Long-term Care Certificate\n\nof Need Act, shall be deemed guilty of a misdemeanor, and upon\n\nconviction shall be punishable by payment of a fine of not less than\n\nOne Thousand Dollars ($1,000.00) and not more than Five Thousand\n\nDollars ($5,000.00).\n\nB. If the State Department of Health, through one of its agents\n\nor representatives, notifies in writing, through certified mail,\n\nreturn receipt requested, the person who has unlawfully commenced\n\nthe offering or development of a long-term care facility to cease\n\nand desist, then each day that such person continues such offering\n\nor development shall be a separate offense.
