If upon inspection or investigation, or whenever the\n\nDepartment determines that there are reasonable grounds to believe\n\nthat a hospice is operating in violation of the Oklahoma Hospice\n\nLicensing Act, or any rule promulgated pursuant to the Oklahoma\n\nHospice Licensing Act, or any order of the Department pursuant to\n\nthe Act, the Department shall give written notice to the alleged\n\nviolator specifying the cause of complaint. Such notice shall\n\nrequire that the matters complained of be corrected within forty-\n\nfive (45) days or that the alleged violator appear before the\n\nDepartment at a time and place specified in the notice and answer\n\ncharges. The notice shall be delivered to the alleged violator in\n\naccordance with the provisions of the Administrative Procedures Act,\n\nSection 301 et seq. of Title 75 of the Oklahoma Statutes.\n\nB. The Department shall give the notice specified by the\n\nprovisions of subsection A of this section within ten (10) days of\n\nan inspection or investigation of the hospice if the Department\n\ndetermines that the hospice is in violation of the Oklahoma Hospice\n\nLicensing Act, the rules promulgated by the Board pursuant to the\n\nOklahoma Hospice Licensing Act, or any order of the Department\n\npursuant to the Act.\n\nC. The Department shall afford the alleged violator an\n\nopportunity for a fair hearing within sixty (60) days of receipt of\n\nnotice provided by subsection A of this section in accordance with\n\nthe provisions of the Administrative Procedures Act, Section 301 et\n\nseq. of Title 75 of the Oklahoma Statutes. On the basis of the\n\nevidence produced at the hearing, the Department shall make findings\n\nof fact and conclusions of law and enter an order thereon. The\n\nDepartment shall give written notice of such order to the alleged\n\nviolator and to such persons as shall have appeared at the hearing\n\nand made written request for notice of the order. If the hearing is\n\nheld before any person other than the Department, such person shall\n\ntransmit the record of the hearing together with recommendations for\n\nfindings of fact and conclusions of law to the Department which\n\nshall thereupon enter its order. The Department may enter its order\n\non the basis of such record or, before issuing its order, may\n\nrequire additional hearings or further evidence to be presented.\n\nThe order of the Department shall become final and binding on all\n\nparties unless appealed to the Supreme Court as provided in the\n\nAdministrative Procedures Act, Section 301 et seq. of Title 75 of\n\nthe Oklahoma Statutes, within thirty (30) days after notice has been\n\nsent to the parties.\n\nD. Except as otherwise expressly provided by law, any notice,\n\norder, or other instrument issued by or pursuant to authority of the\n\nDepartment may be served on any person affected thereby personally,\n\nby publication, or by mailing a copy of the notice, order, or other\n\ninstrument by certified mail, return receipt requested, directed to\n\nthe person affected at his last-known post office address as shown\n\nby the files or records of the Department. Proof of service shall\n\nbe made as in the case of service of a summons or by publication in\n\na civil action or may be made by the affidavit of the person who did\n\nthe mailing. Such proof of service shall be kept on file in the\n\nDepartment.\n\nE. The hearings authorized by this section may be conducted by\n\nthe Department. The Department may designate hearing officers who\n\nshall have the power and authority to conduct such hearings in the\n\nname of the Department at any time and place.
