Stat. tit. 63, § 63-1-860.5","heading":"Department - Powers and duties","body":"The State Department of Health shall have the power and duty to:\n\n1. Issue, renew, deny, modify, suspend and revoke first-year\n\nand permanent licenses for hospice programs pursuant to the\n\nprovisions of the Oklahoma Hospice Licensing Act;\n\n2. Establish and enforce standards and requirements for\n\nlicensure of hospice programs and require the submission of, and to\n\nreview, reports from any person establishing or operating a hospice\n\nprogram;\n\n3. Establish and enforce construction standards and other\n\nrequirements for hospice inpatient facilities; provided, however,\n\nsuch standards and requirements shall comply with current Medicare\n\nregulations for hospice inpatient facilities;\n\n4. Establish a construction plan review fee for such\n\nfacilities; provided, however, the amount of such fee shall not\n\nexceed the amount set by the Department for construction plan review\n\nfees for hospitals;\n\n5. Enter upon any public or private property, with permission,\n\nfor the purpose of inspecting and investigating conditions of the\n\npatients in a hospice or for the purpose of inspecting and\n\ninvestigating a hospice for compliance with the provisions of the\n\nOklahoma Hospice Licensing Act, or the standards or requirements for\n\nlicensure developed by the Department pursuant to the provisions of\n\nthe Oklahoma Hospice Licensing Act;\n\n6. Employ or designate personnel to conduct investigations and\n\ninspections, to make reports of the condition of hospices and the\n\npatients of such hospices, and to take necessary action pursuant to\n\nthe provisions of the Oklahoma Hospice Licensing Act to protect and\n\nsafeguard the health, safety and welfare of patients of hospices;\n\n7. Establish a procedure for receipt and investigation of\n\ncomplaints regarding a hospice or concerning the condition, care and\n\ntreatment of a patient in the hospice;\n\n8. Advise, consult and cooperate with other agencies of this\n\nstate, the federal government, other states and interstate agencies,\n\nand with affected groups and political subdivisions to further the\n\npurposes of the provisions of the Oklahoma Hospice Licensing Act;\n\n9. Develop and enforce rules subject to the approval of the\n\nState Board of Health to implement the provisions of the Oklahoma\n\nHospice Licensing Act;\n\n10. Establish and enforce penalties for violations of the\n\nprovisions of the Oklahoma Hospice Licensing Act as authorized by\n\nthe Board pursuant to the provisions of the Oklahoma Hospice\n\nLicensing Act; and\n\n11.
