No public or private agency or person shall establish,\n\nconduct or maintain a hospice program or hold itself out to the\n\npublic as a hospice program without first obtaining a first-year or\n\npermanent license from the State Department of Health.\n\nB. An application for a hospice program first-year or permanent\n\nlicense shall be filed on a form prescribed by the Department and\n\nshall be accompanied by:\n\n1. The first-year or permanent license fee required by Section\n\n1-860.15 of this title;\n\n2. Documentation of complete disclosure for the applicant which\n\nshall include, but not be limited to, the name, mailing address and\n\nfinding address of every stockholder with at least five percent (5%)\n\nownership interest in the hospice program;\n\n3. Satisfactory proof that the hospice program is in compliance\n\nwith the provisions of the Oklahoma Hospice Licensing Act and any\n\nrules and minimum standards promulgated by the State Board of Health\n\npursuant to the Oklahoma Hospice Licensing Act; and\n\n4. Proof of sufficient financial ability to operate and conduct\n\nthe hospice program in accordance with the requirements of the\n\nOklahoma Hospice Licensing Act.\n\nC. The initial application shall be accompanied by a plan for\n\nthe delivery of home and inpatient hospice services to patients and\n\ntheir families. Such plan shall contain, but not be limited to:\n\n1. The estimated average number of patients to be served\n\nmonthly;\n\n2. The geographic area in which hospice services will be\n\navailable;\n\n3. A listing of services which are or will be provided, either\n\ndirectly by the applicant or through contractual arrangements with\n\nexisting health care providers;\n\n4. Provisions for the implementation of hospice home care\n\nwithin three (3) months of licensure;\n\n5. The name and qualifications of any existing or potential\n\nhealth care provider with whom the hospice program may enter into a\n\ncontract;\n\n6. The projected annual operating cost of the hospice program;\n\nand\n\n7. The location and proposed construction drawings for any\n\nhospice inpatient facility operated by the hospice program. A\n\nlicensed hospice program shall not operate more than one hospice\n\ninpatient facility.\n\nD. Unless suspended or revoked, a first-year license issued for\n\nthe operation of a hospice program shall expire automatically one\n\n(1) year from the date of issuance; provided, this provision shall\n\nnot apply if the Department has not completed a follow-up survey of\n\nthe hospice program. The Department may renew a first-year license\n\nfor up to one (1) additional year beyond the expiration date if the\n\napplicant has complied with the provisions of the Oklahoma Hospice\n\nLicensing Act and the rules promulgated by the Board for the\n\noperation of a hospice program under a first-year license.\n\nE. Unless suspended or revoked, a permanent license issued for\n\nthe operation of a hospice program shall expire automatically one\nar license\n\nfor up to one (1) additional year beyond the expiration date if the\n\napplicant has complied with the provisions of the Oklahoma Hospice\n\nLicensing Act and the rules promulgated by the Board for the\n\noperation of a hospice program under a first-year license.\n\nE. Unless suspended or revoked, a permanent license issued for\n\nthe operation of a hospice program shall expire automatically one\n\n(1) year from the date of issuance. At least sixty (60) days prior\n\nto the expiration date, an application for license renewal shall be\n\nsubmitted to the Department on forms furnished by the Department.\n\nThe license shall be renewed if the applicant has complied with the\n\nprovisions of the Oklahoma Hospice Licensing Act and all rules\n\npromulgated by the Board pursuant to the provisions of the Oklahoma\n\nHospice Licensing Act. The application for license renewal shall be\n\naccompanied by an update of the plan for delivery of hospice\n\nservices only if information contained in the plan submitted\n\npursuant to subsection C of this section is no longer applicable.\n\nF. A hospice program for which a revocation or suspension\n\nproceeding is pending at the time of license renewal may be issued a\n\nconditional license effective until final disposition by the\n\nDepartment of such proceeding. If judicial relief is sought from\n\nthe final disposition, the court having jurisdiction may issue a\n\nconditional permit for the duration of the judicial proceeding.\n\nG. The license shall:\n\n1. Be displayed in a conspicuous place inside the hospice\n\nprogram office;\n\n2. Be valid only in the possession of the person or public\n\nagency to which it is issued;\n\n3. Not be subject to sale, assignment, or other transfer,\n\nvoluntary or involuntary;\n\n4. Not be valid for any hospice program other than the hospice\n\nprogram for which the license was originally issued; and\n\n5. Restrict the number of patients in a hospice inpatient\n\nfacility to the Department-approved occupancy level for each\n\nfacility.\n\nH. Any person who, prior to January 1, 1991, provided hospice\n\nservices to any patient shall be entitled to operate as a hospice\n\nprogram pursuant to the provisions of the Oklahoma Hospice Licensing\n\nAct without making application and obtaining a license pursuant to\n\nthe provisions of the Oklahoma Hospice Licensing Act for one (1)\n\nyear after September 1, 1991, provided such person otherwise\n\ncomplies with the provisions of the Oklahoma Hospice Licensing Act\n\nand all rules promulgated by the Board pursuant to the act.\n\nThereafter any person providing hospice services shall make\n\napplication, obtain a license, and comply with the provisions of the\n\nOklahoma Hospice Licensing Act and all rules promulgated by the\n\nBoard pursuant to the act.","path":["OK Code","Title 63"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os63.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"0712dea0727b6abd031b9874dbd85ee305fac3ac0ab66d1b0932e9916f060cc5","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-63-63-1-860.5","next":"us-ok/okla.-stat.-tit.-63-63-1-860.7"},"notice":"GroundRules: Original legal text.
