After notice and hearing pursuant to the provisions of\n\nSection 1-860.10 of this title, the State Department of Health may:\n\n1. Deny a first-year or permanent license to an applicant who\n\ndoes not meet the requirements for licensure pursuant to the\n\nprovisions of the Oklahoma Hospice Licensing Act;\n\n2. Refuse to renew, suspend or revoke a first-year or permanent\n\nlicense to a hospice which is not in compliance with the provisions\n\nof the Oklahoma Hospice Licensing Act or with the rules promulgated\n\nby the State Board of Health pursuant to the provisions of the\n\nOklahoma Hospice Licensing Act;\n\n3. Deny, refuse to renew, suspend or revoke a first-year or\n\npermanent license to an applicant or hospice which has a history of\n\nnoncompliance or incomplete or partial compliance with the\n\nprovisions of the Oklahoma Hospice Licensing Act or with the rules\n\npromulgated by the Board pursuant to the Oklahoma Hospice Licensing\n\nAct, or for which there is other satisfactory evidence which\n\ndemonstrates that the applicant or hospice is unlikely to provide\n\ncare or treatment to the patients in the care of the hospice in a\n\nmanner which warrants public trust;\n\n4. Deny, refuse to renew, suspend or revoke a first-year or\n\npermanent license to an applicant or hospice which has insufficient\n\nfinancial or other resources to the extent that the applicant or\n\nhospice is incapable of ensuring or providing adequate care or\n\ntreatment to the patients; or\n\n5. Assess administrative penalties pursuant to Article II of\n\nthe Administrative Procedures Act.\n\nB. Any of the following actions by a hospice or any of its\n\nemployees shall be grounds for action by the Department against a\n\nhospice:\n\n1. A violation of the provisions of the Oklahoma Hospice\n\nLicensing Act or of any of the rules promulgated thereto; or\n\n2.
