Stat. tit. 63, § 63-1-865.2","heading":"Definitions","body":"As used in the Sheltered Workshop Act:\n\n1. “Community services worker” means any person who:\n\na. contracts with the Oklahoma Health Care Authority to\n\nprovide specialized foster care, habilitation training\n\nspecialist services, or homemaker services to persons\n\nwith developmental disabilities,\n\nb. is not a licensed health professional, and\n\nc. is employed by or under contract with a community\n\nservices provider to provide for compensation or as a\n\nvolunteer the following:\n\n(1) health-related services,\n\n(2) training, or\n\n(3) supportive assistance;\n\n2. “Contract” means the binding legal agreement to provide\n\nsheltered workshop services, entered into between the provider and\n\nthe Developmental Disabilities Services Division of the Department\n\nof Human Services or the Oklahoma Health Care Authority;\n\n3. “DDSD” means the Developmental Disabilities Services\n\nDivision of the Department of Human Services;\n\n4. “Department” means the Department of Human Services;\n\n5. “Developmental disability” means a severely chronic\n\ndisability of a person which:\n\na. is attributable to a physical or mental impairment or\n\na combination of physical or mental impairments,\n\nb. is manifested before the person attains the age of\n\ntwenty-two (22) years,\n\nc. is likely to continue indefinitely,\n\nd. results in substantial functional limitations in three\n\nor more of the following areas of major life activity:\n\n(1) self-care,\n\n(2) receptive and expressive language,\n\n(3) learning,\n\n(4) mobility,\n\n(5) self-direction,\n\n(6) capacity for independent living, or\n\n(7) economic self-sufficiency, and\n\ne. reflects the need of the person for a combination and\n\nsequence of special interdisciplinary or generic care,\n\ntreatment or other services which are of lifelong or\n\nextended duration and are individually planned and\n\ncoordinated;\n\n6. “Director” means the Director of Human Services;\n\n7. “Licensee” means a person, corporation, partnership, limited\n\nliability company, or association operating a sheltered workshop\n\nwhich is licensed pursuant to the provisions of the Sheltered\n\nWorkshop Act;\n\n8. “Provider” means a person, corporation, partnership, limited\n\nliability company, association, or other entity that contracts with\n\nthe Developmental Disabilities Services Division of the Department\n\nof Human Services or the Oklahoma Health Care Authority to operate a\n\nsheltered workshop for persons with developmental disabilities;\n\n9. “Service recipient” means a person participating in the\n\nsheltered workshop; and\n\n10. “Sheltered workshop” means a facility, or any portion\n\nthereof, operated by a nonprofit organization, corporation,\n\npartnership, limited liability company or association whose purpose\n\nis to provide meaningful work or training activities to individuals\n\nwith developmental disabilities and holds a current certificate\n\nunder Section 14c of the Fair Labor Standards Act by the Wage and\n\nHour Division, U.S. Department of Labor.","path":["OK Code","Title 63"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os63.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"a31b842fb54ff516e503eaee946d5976a4f071eec9c8ed5a68143bc5f7f0ac09","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-63-63-1-865.1","next":"us-ok/okla.-stat.-tit.-63-63-1-865.3"},"notice":"GroundRules: Original legal text.
