Stat. tit. 63, § 63-1-865.3","heading":"Department of Human Services – Powers and duties –","body":"Sheltered workshops.\n\nA. The Department of Human Services shall have the power and\n\nduty to:\n\n1. Enforce any provision of the Sheltered Workshop Act;\n\n2. Issue, renew, deny, modify, suspend, and revoke licenses for\n\nsheltered workshops pursuant to the provisions of the Sheltered\n\nWorkshop Act; provided, however, providers of sheltered workshop\n\nservices that have a contract with the Developmental Disabilities\n\nServices Division of the Department of Human Services or the\n\nOklahoma Health Care Authority to provide sheltered workshop\n\nservices as of November 1, 2011, shall be deemed to be licensed,\n\nsubject to the continuing requirements of the Sheltered Workshop\n\nAct;\n\n3. Establish and enforce standards and requirements for\n\nlicensure and operation of sheltered workshops that are subject to\n\nthe provisions of the Sheltered Workshop Act and require the\n\nsubmission of, and to review, reports from any person establishing\n\nor operating a sheltered workshop;\n\n4. Enter upon any public or private property for the purpose of\n\ninspecting and investigating conditions of the sheltered workshop\n\nfor compliance with the provisions of the Sheltered Workshop Act, or\n\nthe standards and requirements for licensure and operation of\n\nsheltered workshops developed by the Department pursuant to the\n\nprovisions of the Sheltered Workshop Act;\n\n5. Employ or designate personnel to conduct investigations and\n\ninspections, to make reports of the condition of sheltered\n\nworkshops, and to take necessary action pursuant to the provisions\n\nof the Sheltered Workshop Act to protect and safeguard the health,\n\nsafety, and welfare of service recipients;\n\n6. Advise, consult, and cooperate with other agencies of this\n\nstate, the federal government, other states and interstate agencies,\n\nand with affected groups and political subdivisions to further the\n\npurposes of the Sheltered Workshop Act;\n\n7. Investigate, request or otherwise obtain the information\n\nnecessary to determine the qualifications and background of an\n\napplicant for licensure or contract;\n\n8. Provide the sheltered workshop thirty (30) days written\n\nnotice that its license is to be suspended or revoked, and shall\n\ntake action at the end of that time if the sheltered workshop\n\nremains out of compliance. However, if the health and safety of\n\nservice recipients is threatened, the suspension or revocation shall\n\nbe effective immediately and the sheltered workshop shall be closed;\n\n9. Notify holders of suspended or revoked licenses that they\n\nshall be entitled to a hearing before Department licensure officials\n\nif requested within ten (10) days of their notification. The\n\nhearing shall be held at least ten (10) days before final action is\n\ntaken and conducted pursuant to the Administrative Procedures Act;\n\nand\n\n10. Reinstate suspended licenses if deficiencies are corrected\n\nwithin a time frame established by the Department.\n\nB. The Department of Human Services shall develop rules\n\nestablishing minimum standards for sheltered workshops. These\n\nstandards, at minimum, shall regulate:\n\n1. Physical plant expectations to include physical facilities,\n\nventilation, and accessibility;\n\n2. Staffing requirements;\n\n3. Staff training;\n\n4. Staff qualifications; and\n\n5.
