At the time of the referral, a referral agency shall\n\ndisclose the following to the consumer:\n\n1. A description of the referral agency's service;\n\n2. A statement on whether the consumer or the assisted living\n\ncenter or continuum of care facility to which the consumer is\n\nreferred is responsible for paying the referral fee; and\n\n3. A statement that the consumer may, without cause or penalty,\n\nstop using the referral agency. The referral agency shall\n\ncommunicate this decision by the consumer to all assisted living\n\ncenters or continuum of care facilities to which the consumer has\n\nbeen referred upon being notified by the consumer that they plan to\n\nstop using the referral agency. Notification by a consumer shall\n\nnot affect the contractual agreement between the referral agency and\n\nthe assisted living center or continuum of care facilities.\n\nB. The referral agency shall make the disclosure statement\n\navailable to a consumer in a clear and conspicuous written physical\n\nor electronic document.\n\nC. The referral agency shall take into account the consumers'\n\npreferences in selecting the assisted living center or continuum of\n\ncare facility to which it refers the consumer and cost shall not be\n\nused as the sole factor in that selection.\n\nD.
