Refer a consumer to an assisted living center or continuum\n\nof care facility in which the referral agency has an ownership,\n\nmanagement, or financial interest excluding a de minimis interest,\n\nsuch as a direct or indirect ownership of less than one percent (1%)\n\nof an assisted living center or continuum of care facility;\n\n2. Hold a power of attorney or hold property in any capacity\n\nfor a consumer or for whom a referral is made;\n\n3. Refer a consumer to an assisted living center or continuum\n\nof care facility that, to the referral agency's knowledge, is\n\nunlicensed and is not exempt from licensing under applicable law;\n\n4. Collect a fee for a consumer transferring from one location\n\nof an assisted living center or continuum of care facility to\n\nanother location of the same assisted living center or continuum of\n\ncare facility unless the consumer has engaged the referral agency to\n\nhelp facilitate the transfer to a new location and the consumer has\n\nbeen provided with more than one referral; or\n\n5.
