Use a nationally accredited service provider to obtain\n\ncriminal history record information upon hire, on a referral agency\n\nemployee who has direct contact with a consumer; provided, however,\n\nthat a referral agency employee who physically enters an assisted\n\nliving center or continuum of care facility with the purpose of\n\nmaking a referral on behalf of a consumer, shall obtain a criminal\n\nbackground check, in accordance with paragraph 1 of subsection I of\n\nSection 1-1947 of Title 63 of the Oklahoma Statutes;\n\n2. Maintain liability insurance coverage for negligent acts or\n\nomissions by the referral agency or its employees;\n\n3. Audit each assisted living center or continuum of care\n\nfacility to which the referral agency provides referrals to ensure\n\nthat any applicable license is in good standing and maintain a\n\nrecord of that audit;\n\n4. Provide all referral agency employees whose job\n\nresponsibilities require direct contact with a consumer with\n\nintroductory training, including training on the referral agency's\n\ncode of conduct, before the employee begins performing those\n\nresponsibilities;\n\n5. Provide an assisted living center or continuum of care\n\nfacility with the time and date on which any referral has been made\n\nto the assisted living center or continuum of care facility in a\n\nclear and conspicuous written physical or electronic document on or\n\nbefore the date the consumer is admitted; and\n\n6. After November 1, 2024, provide any new written contract\n\nwith an assisted living center or continuum of care facility for\n\nwhich it is making referrals the length of time that a referral\n\nagency shall be paid from the date that the referral was made to the\n\nassisted living center or continuum of care facility not to exceed\n\nthirty-six (36) months.","path":["OK Code","Title 63"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os63.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"b8c141b920854479378e1327a9ed991a0b16f44fc5e581ddcf841248df674a21","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-63-63-1-866.3","next":"us-ok/okla.-stat.-tit.-63-63-1-866.5"},"notice":"GroundRules: Original legal text.
