Stat. tit. 63, § 63-1-873","heading":"Licensure requirements and standards - Centers required","body":"to be licensed.\n\nA. The State Commissioner of Health, with the advice of the\n\nLong-Term Care Facility Advisory Board, created pursuant to Section\n\n1-1923 of this title, shall define minimum adult day care licensure\n\nrequirements and rules including standards for:\n\n1. Health and social services which may be provided to\n\nparticipants;\n\n2. The range of services to be provided by a center based on\n\nthe type of participants to be served;\n\n3. Staff to participant ratios;\n\n4. Staff and volunteer qualifications;\n\n5. Staff training;\n\n6. Food services;\n\n7. Participant records and care plans;\n\n8. Antidiscrimination policies;\n\n9. Sanitary and fire standards; and\n\n10. Any other requirements necessary to ensure the safety and\n\nwell-being of frail elderly and disabled adults.\n\nB. Centers to be licensed shall include all adult day care\n\ncenters. Sheltered workshops and senior recreational centers which\n\ndo not receive participant fees for services are not required to be\n\nlicensed. It shall be unlawful to operate a center without first\n\nobtaining a license for such operation as required by the Adult Day\n\nCare Act, regardless of other licenses held by the operator.\n\nOrganizations operating more than one center shall obtain a license\n\nfor each site.\n\nC. The license for operation of a center shall be issued by the\n\nState Department of Health. The license shall:\n\n1. Not be transferable or assignable;\n\n2. Be posted in a conspicuous place on the licensed premises;\n\n3. Be issued only for the premises named in the application;\n\nand\n\n4. Expire thirty-six (36) months from the date of issuance,\n\nprovided an initial license shall expire one hundred eighty (180)\n\ndays after the date of issuance. Licenses may be issued for a\n\nperiod of more than twelve (12) months, but not more than thirty-six\n\n(36) months, for the licensing period immediately following November\n\n1, 2021, in order to permit an equitable distribution of license\n\nexpiration dates to all months of the year.\n\nD. A center shall meet the safety, sanitation and food service\n\nstandards of the State Department of Health.\n\nE. Local health, fire and building codes relating to adult day\n\ncare centers shall be classified as an education use group.\n\nF.
