Stat. tit. 63, § 63-1-879.2c","heading":"Required disclosure – Promulgation of rules -","body":"Alzheimer-Dementia Disclosure Act Advisory Council.\n\nA. 1. Pursuant to rules promulgated under the provisions of\n\nthe Alzheimer’s Dementia and Other Forms of Dementia Special Care\n\nDisclosure Act, any nursing facility, residential care facility,\n\nassisted living facility, adult day care center, continuum of care\n\nfacility, or special care facility that publicly advertises,\n\nintentionally markets, or otherwise engages in promotional campaigns\n\nfor the purpose of communicating that such facility offers care,\n\nmemory care, or treatment methods within the facility that\n\ndistinguish it as being especially applicable to or suitable to\n\npersons with Alzheimer’s dementia or other forms of dementia\n\ndiagnoses shall disclose the type of care, memory care, or treatment\n\nprovided that distinguishes it as being especially applicable to or\n\nsuitable for such persons.\n\n2. The disclosure shall be made using a form developed by the\n\nState Department of Health and shall be made to:\n\na. the Department,\n\nb. any representative of a person with Alzheimer’s\n\ndementia or other form of dementia who is considering\n\nplacement within a special care unit, program, or\n\nfacility, and\n\nc. the State Long-Term Care Ombudsman.\n\n3. A referral agency, when disclosing documents pursuant to\n\nSection 1-866.2 of this title, shall provide any representative of a\n\nperson who has notified the referral agency of a diagnosis of\n\nAlzheimer’s dementia or other form of dementia and who is\n\nconsidering placement within a unit, program, memory care, or\n\nfacility, electronic or physical access to the form for each\n\nfacility. The Department of Health shall maintain a public\n\nsearchable database of forms. If no such form is available from the\n\nDepartment of Health, this section shall not apply. Neither a\n\nfacility nor a referral agency shall be liable for the actions or\n\ninactions of the other pursuant to this section.\n\n4. The facility shall submit the disclosure form to the\n\nDepartment prior to entering into any agreement to provide care or\n\nservices.\n\n5. The Department shall examine each disclosure for\n\ncompleteness and accuracy at the time the disclosure is submitted to\n\nthe Department.\n\n6. The Department shall review the most recent disclosure in\n\nthe Department’s records during the facility’s regular inspection to\n\nverify that the disclosure is current and that the services\n\ndescribed in the disclosure are provided to residents as described\n\nin the disclosure.\n\nB. The information disclosed as required by this section shall\n\ninclude the following areas:\n\n1. A written description of the special care unit, program, or\n\nfacility’s overall philosophy and mission as it relates to the needs\n\nof residents with Alzheimer’s dementia or other forms of dementia;\n\n2. The process and criteria for placement in, or transfer or\n\ndischarge from, the unit, program, or facility;\n\n3. The process used for assessment, establishment, and\n\nimplementation of a resident plan of care, as it relates to\n\nAlzheimer’s dementia and other forms of dementia, including the\n\nmethod by which the plan evolves, the frequency of assessment, and\n\nhow the facility will respond to changes in the condition of the\n\nresident;\n\n4. Staff-to-resident ratios, staff training and continuing\n\neducation that are in addition to all regularly prescribed training\n\nand are commensurate with the need for increased care and\n\nsupervision for residents with Alzheimer’s dementia or other forms\n\nof dementia;\n\n5. The physical environment and design features appropriate to\n\nsupport the functioning of cognitively impaired residents;\n\n6. The types and frequency of resident activities designed for\n\nresidents with Alzheimer’s dementia or other forms of dementia and\n\ndescriptions of those therapeutic activities designed to address\n\ncognitive function and engage residents with varying stages of\n\ndementia;\nia;\n\n5. The physical environment and design features appropriate to\n\nsupport the functioning of cognitively impaired residents;\n\n6. The types and frequency of resident activities designed for\n\nresidents with Alzheimer’s dementia or other forms of dementia and\n\ndescriptions of those therapeutic activities designed to address\n\ncognitive function and engage residents with varying stages of\n\ndementia;\n\n7. The involvement of families in care planning and other\n\naspects of care, and the availability of family support programs;\n\n8. The fees for care and any additional fees; and\n\n9. Any accreditations or certifications issued to the facility\n\nrelated to the care and services provided to residents with\n\nAlzheimer’s dementia or other forms of dementia.\n\nC. The Department, with input from the Alzheimer-Dementia\n\nDisclosure Act Advisory Council, shall develop a standardized\n\ndisclosure form. Any change in the information initially submitted\n\nby the facility or other entity shall be reported to the Department\n\nat the time the change is made.\n\nD. The provisions of this section shall not be construed to\n\npreclude a facility without a special care unit or program from\n\nadmitting a person with Alzheimer’s dementia or other forms of\n\ndementia.\n\nE. The State Commissioner of Health, with input from the\n\nAlzheimer-Dementia Disclosure Act Advisory Council, shall promulgate\n\nrules to effectuate the provisions of the Alzheimer’s Dementia and\n\nOther Forms of Dementia Special Care Disclosure Act.\n\nF. There is hereby created the Alzheimer-Dementia Disclosure\n\nAct Advisory Council. The Council shall make recommendations to the\n\nState Commissioner of Health regarding the disclosure form and rules\n\npromulgated pursuant to the Alzheimer’s Dementia and Other Forms of\n\nDementia Special Care Disclosure Act.\n\n1. The Council shall consist of nine (9) members to be\n\nappointed by the State Commissioner of Health for such terms as he\n\nor she chooses. The members shall be individuals who have knowledge\n\nand expertise in the field of memory care or individuals who are\n\nconsumer representatives directly impacted by memory-care services,\n\nprovided that neither the members with knowledge and expertise in\n\nthe field nor the members who are consumer representatives shall\n\ncomprise more than two-thirds (2/3) of the total membership. The\n\nmembers who are consumer representatives shall be individuals with\n\nimmediate family members who have received or are currently\n\nreceiving memory-care services in Oklahoma and shall not be\n\nemployees or board members of any facilities or entities subject to\n\nthe Alzheimer’s Dementia and Other Forms of Dementia Special Care\n\nDisclosure Act.\n\n2. The members of the Council shall serve without compensation.\n\n3. The Council shall conduct an organizational meeting at a\n\ndate and location to be chosen by the Commissioner and as frequently\n\nthereafter as necessary to perform the duties imposed upon it. A\n\nmajority of the members present shall constitute a quorum.\n\n4. Staff assistance for the Council shall be provided by the\n\nstaff of the State Department of Health.\n\nG. If a facility described in paragraph 1 of subsection A of\n\nthis section, or any individual employed or contracted by such\n\nfacility, violates any of the provisions of the Alzheimer’s Dementia\n\nand Other Forms of Dementia Special Care Disclosure Act or the rules\n\npromulgated pursuant thereto, the facility shall be subject to the\n\nnotice and enforcement provisions established for the facility’s\n\nlicense by the Department.\n\nH. Any facility that offers specialized memory or dementia care\n\nthrough a specific unit or program shall post:\n\n1. The disclosure form, including the information required to\n\nbe included by this section, on the facility’s website; and\n\n2. A poster, in a conspicuous location in the special care\n\nunit, program, or facility where care is provided for persons with\nility’s\n\nlicense by the Department.\n\nH. Any facility that offers specialized memory or dementia care\n\nthrough a specific unit or program shall post:\n\n1. The disclosure form, including the information required to\n\nbe included by this section, on the facility’s website; and\n\n2. A poster, in a conspicuous location in the special care\n\nunit, program, or facility where care is provided for persons with\n\nAlzheimer’s dementia or other forms of dementia, stating that if\n\nsuch persons or their representatives were not given a copy of the\n\ndisclosure form, they may file a complaint with the Consumer\n\nProtection Unit of the Office of the Attorney General.\n\nI. The Department shall establish a website with a list of\n\nthose facilities that have filed a disclosure form pursuant to the\n\nAlzheimer’s Dementia and Other Forms of Dementia Special Care\n\nDisclosure Act.
