Stat. tit. 63, § 63-1-880.12","heading":"Payment or acceptance of payment for securing or","body":"soliciting patients for psychiatric or chemical dependency facility.\n\nA. 1. Any person who intentionally or knowingly pays to or\n\naccepts anything of value from any person, firm, association of\n\npersons, partnership, or corporation for securing or soliciting\n\npatients for any psychiatric or chemical dependency facility in this\n\nstate shall be guilty of a misdemeanor, and upon conviction shall be\n\npunishable by payment of a fine of not less than Five Hundred\n\nDollars ($500.00) and not more than Two Thousand Dollars\n\n($2,000.00).\n\n2. In addition to any other penalties or remedies provided by\n\nlaw:\n\na. a violation of this section shall be grounds for\n\ndisciplinary action by the state agency licensing,\n\ncertifying, or registering such professional or\n\nprovider, and\n\nb. the state agency licensing, certifying, or registering\n\nsuch professional or provider may institute an action\n\nto enjoin a violation or potential violation of this\n\nsection. The action for an injunction shall be in\n\naddition to any other action, proceeding, or remedy\n\nauthorized by law.\n\nB. This section shall not be construed to prohibit:\n\n1. Advertising, except that advertising which:\n\na. is false, misleading or deceptive,\n\nb. advertises professional superiority or the performance\n\nof a professional service in a superior manner, and\n\nc. is not readily subject to verification;\n\n2. Remuneration for advertising, marketing or other services\n\nthat are provided for the purpose of securing or soliciting\n\npatients, provided the remuneration is:\n\na. set in advance,\n\nb. consistent with the fair market value of the services,\n\nand\n\nc. not based on the volume or value of any patient\n\nreferrals or business otherwise generated between the\n\nparties; and\n\n3. Any payment, business arrangements, or payments practice not\n\nprohibited by 42 U.S.C., Section 1320a-7b(b), or any regulations\n\npromulgated pursuant thereto.\n\nC. This section shall not apply to licensed insurers, including\n\nbut not limited to, group hospital service corporations, or health\n\nmaintenance organizations which reimburse, provide, offer to\n\nprovide, or administer hospital, medical, dental, or other health-\n\nrelated benefits under a health benefits plan for which it is the\n\npayor when it is providing those services under a health benefits\n\nplan.\n\nD. For purposes of this section:\n\n1. \"Health or mental health care professional\" means any person\n\nwho offers or provides counseling or health or mental health care\n\nunder a license, certification or registration issued pursuant to\n\nTitle 59 of the Oklahoma Statutes, and any drug and alcohol\n\ncounselor certified by a private professional organization or\n\nassociation that offers drug and alcohol certification; and\n\n2. \"Health care provider\" means any hospital or related\n\ninstitution offering or providing outpatient or inpatient\n\npsychiatric or chemical dependency care licensed pursuant to Section\n\n1-702 of Title 63 of the Oklahoma Statutes, or private facility\n\noffering inpatient or outpatient psychiatric or chemical dependency\n\ncare licensed or certified pursuant to Title 43A of the Oklahoma\n\nStatutes.","path":["OK Code","Title 63"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os63.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"97a87ee4e4d91048ebd3575c8b8fd94539008583fd57d5425d350691ef2588d6","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-63-63-1-879.3","next":"us-ok/okla.-stat.-tit.-63-63-1-881"},"notice":"GroundRules: Original legal text.
