The State Commissioner of Health shall promulgate rules\n\nnecessary to implement the provisions of the Continuum of Care and\n\nAssisted Living Act. Such rules shall include, but shall not be\n\nlimited to:\n\n1. A uniform comprehensive resident screening instrument to\n\nmeasure the needs and capabilities of residents in all settings and\n\nto determine appropriate placements of residents;\n\n2. Physical plant requirements meeting construction and life\n\nsafety codes, with provisions accommodating resident privacy and\n\nindependence in assisted living centers and in assisted living\n\ncomponents of continuum of care facilities based on the variable\n\ncapabilities of residents;\n\n3. Staffing levels responsive to the variable needs of\n\nresidents, with provisions for sharing of staff between components\n\nin a continuum of care facility;\n\n4. Minimum standards for resident care including, but not\n\nlimited to, standards pertaining to medical care and administration\n\nof medications. Standards pertaining to medication administration\n\nshall, at a minimum, require the assisted living center or continuum\n\nof care facility to:\n\na. provide or arrange qualified staff to administer\n\nmedications based on the needs of residents,\n\nb. follow medication administration orders from a\n\nqualified health care provider,\n\nc. ensure that medications are reviewed monthly by a\n\nRegistered Nurse or pharmacist and quarterly by a\n\nconsultant pharmacist,\n\nd. maintain medication administration records and\n\ndocument all medication administration in such\n\nrecords, and\n\ne. have medication storage and disposal policies;\n\n5. Standards for measuring quality outcomes for residents;\n\n6. Provisions for individualized services chosen by and\n\ndesigned for each resident;\n\n7. Provisions to prohibit facility staff from disclosing a\n\nresident’s financial information to third parties without written\n\nconsent of the resident or the designated representative of the\n\nresident;\n\n8. Procedures for inspections and investigations of licensed\n\nentities to ensure compliance with the Continuum of Care and\n\nAssisted Living Act and rules promulgated by the Commissioner;\n\n9. Enumeration of resident rights and responsibilities to be\n\nobserved by each facility and its staff. Such resident rights shall\n\ninclude the freedom of choice regarding any personal attending\n\nphysicians and all other providers of medical services and supplies,\n\nproviding that the minimum standards are met by the provider\n\npursuant to the Continuum of Care and Assisted Living Act, without a\n\nfinancial penalty or fee charged by the assisted living center;\n\n10. Provisions for a surety bond or deposit from each applicant\n\nin an amount sufficient to guarantee that obligations to residents\n\nwill be performed, with provisions for reduction or waiver of the\n\nsurety bond or deposit when the assets of the applicant or its\n\ncontracts with other persons are sufficient to reasonably ensure the\n\nperformance of its obligations;\n\n11. Provisions for the development of a consumer guide or\n\nsimilar resource to be posted on the Internet website of the State\n\nDepartment of Health to assist individuals and families in\n\nunderstanding the services provided by assisted living centers and\n\nto compare and select a facility;\n\n12. Provisions for posting results of routine inspections and\n\nany complaint investigations of each assisted living center on the\n\nInternet website of the Department. Such information shall be\n\nregularly updated to include the facility’s plan of correction and\n\nto indicate when a violation of a licensing regulation was corrected\n\nby the facility; and\n\n13. Provisions requiring execution of a plan of care and a\n\nresident service contract with the resident or resident’s\n\nrepresentative.\n\nB. The nursing care service of a continuum of care facility\n\nshall be subject to the requirements, procedures and remedies set\nnclude the facility’s plan of correction and\n\nto indicate when a violation of a licensing regulation was corrected\n\nby the facility; and\n\n13. Provisions requiring execution of a plan of care and a\n\nresident service contract with the resident or resident’s\n\nrepresentative.\n\nB. The nursing care service of a continuum of care facility\n\nshall be subject to the requirements, procedures and remedies set\n\nout in the Nursing Home Care Act, including provisions relating to\n\nresident rights.\n\nC.
