Stat. tit. 63, § 63-103","heading":"Post mortem caesarian section - Right to perform -","body":"Nonliability of physician and hospital.\n\nIt shall be lawful for a physician, legally qualified to\n\npractice in the State of Oklahoma, to perform a post mortem\n\ncaesarian section upon any female who is the victim of accidental\n\ndeath, who at the time of said death, is in the advanced stages of\n\npregnancy and where said physician has reason to believe, following\n\nimmediate and due examination, that said child is viable in the\n\nmother. In the performance of a caesarian section, under such\n\ncircumstances, the physician and the institution or hospital where\n\nsuch operation is performed, shall not be liable, either civilly or\n\ncriminally, though performed without the consent by those in whom\n\nthe law has recognized a legal right of the possession of the body\n\nof the deceased, provided the operation be performed in good faith\n\nand with due skill and without unnecessary injury or mutilation.\n\nProvided, however, said operation shall not be performed over the\n\nprotest of those in whom the law has recognized a legal right to the\n\npossession of the body of the said deceased.","path":["OK Code","Title 63"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os63.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"d80045044b5339ed43074c046b0df2d51fd5634ec48130f82c261791b5c31993","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-63-63-102","next":"us-ok/okla.-stat.-tit.-63-63-104"},"notice":"GroundRules: Original legal text.
