Stat. tit. 63, § 63-1078","heading":"Eminent domain","body":"An authority shall have the right to acquire by the exercise of\n\nthe power of eminent domain any real property or interest therein\n\nwhich it may deem necessary for its purposes under this act after\n\nthe adoption by it of a resolution declaring that the acquisition of\n\nthe real property described therein is necessary for such purposes.\n\nAn authority may exercise the power of eminent domain in the same\n\nmanner and by like proceedings as provided for railroad corporations\n\nunder the laws of this state.\n\nProperty already devoted to a public use may be acquired in like\n\nmanner, provided that no real property belonging to any city,\n\ncounty, or any other political subdivision of the state may be\n\nacquired without its consent.\n\nIn the event any housing authority in exercising any of the\n\npowers conferred by this act makes necessary the relocation,\n\nraising, rerouting or changing the grade of or altering the\n\nconstruction of any railroad, common carrier, public utility\n\nproperty or facility, all such relocation, raising, rerouting,\n\nchanging of grade or alteration of construction shall be\n\naccomplished at the expense of the housing authority, provided that\n\nthe housing authority shall not disturb the possession or operation\n\nof any railroad, common carrier, or public utility in or to the\n\nappropriated property or facility until the relocated property or\n\nfacilities are available for use and until marketable title thereto\n\nhas been transferred to the railroad, common carrier or public\n\nutility.","path":["OK Code","Title 63"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os63.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"a8c155867f953f9d685ea648b9397c39da1655e41494aa9486add4f4ad4061e2","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-63-63-1077","next":"us-ok/okla.-stat.-tit.-63-63-1079"},"notice":"GroundRules: Original legal text.
