Stat. tit. 63, § 63-122.2","heading":"Jurisdictional areas of state agencies","body":"The provisions of this section specify the jurisdictional areas\n\nof state agencies relating to the regulation of blasting and\n\nexplosives. Agencies regulating explosives and blasting are\n\ndirected to cooperate and coordinate with each other as necessary to\n\ncarrying out the duties required to regulate explosives. Agencies\n\nregulating explosives may enter into interagency agreements with\n\nother state agencies and law enforcement agencies of any political\n\nsubdivision of this state for the purpose of conducting\n\ninvestigations related to the regulation of explosives or criminal\n\nactivity. The jurisdictional areas of responsibility specified in\n\nthis section shall be in addition to those otherwise provided by law\n\nand assigned to the specific state agency as follows:\n\n1. Department of Mines. The Department of Mines shall have the\n\nfollowing jurisdictional areas relating to the regulation of\n\nblasting and explosives:\n\na. the use of explosives and blasting activities for\n\nsurface and nonsurface mining operations pursuant to\n\nTitle 45 of the Oklahoma Statutes,\n\nb. except as otherwise provided by this part, the use of\n\nexplosives and blasting activities for nonmining\n\nactivities, and\n\nc. except as otherwise provided by this part, the\n\nregulation of the use of explosives or of blasting\n\nactivity not subject to the specific statutory\n\nauthority of another state agency;\n\n2. State Fire Marshal. The State Fire Marshal shall have\n\nregulatory jurisdictional responsibility relating to explosives as\n\nfollows:\n\na. the regulation of the manufacture, sale,\n\ntransportation for hire or storage of explosives or\n\nblasting agents for resale pursuant to Division 2 of\n\nthe Oklahoma Explosives and Blasting Regulation Act,\n\nb. the examination of buildings and premises and\n\nreporting and orders authorized pursuant to Section\n\n317 of Title 74 of the Oklahoma Statutes, and\n\nc. licensure, regulation and enforcement of fire\n\nextinguishers, pursuant to the Fire Extinguisher\n\nLicensing Act;\n\n3. The Department of Public Safety. The Department of Public\n\nSafety shall have the regulatory jurisdictional responsibility\n\nrelating to explosives as follows:\n\na. the transportation of explosives or blasting agents\n\nclassified as hazardous materials pursuant to the\n\nOklahoma Motor Carrier Safety and Hazardous Materials\n\nTransportation Act,\n\nb. the construction or making of any explosive or\n\nexplosive device not subject to specific regulatory\n\nauthority of another state agency,\n\nc. the intentional storage of any materials which are\n\nintended to be used to construct or make any explosive\n\nor explosive device not subject to specific regulatory\n\nauthority of another state agency, and\n\nd. the intentional use of any explosive or explosive\n\ndevice in any manner not subject to specific\n\nregulatory authority of another state agency.\n\nProvided, nothing in this provision shall be construed to expand\n\njurisdiction of the Department of Public Safety to investigate any\n\ncrime occurring within the jurisdiction of another law enforcement\n\nauthority of any political subdivision of this state, and nothing\n\nshall prohibit, limit, or restrict any law enforcement officer,\n\nagency, or specialized law enforcement unit from investigating or\n\notherwise performing any duty or responsibility for crimes within\n\ntheir respective jurisdiction relating to explosives, blasting\n\nagents, or hazardous materials; and\n\n4. Department of Environmental Quality. The Department of\n\nEnvironmental Quality shall have jurisdictional responsibility\n\nrelating to the regulation and disposal of explosives or blasting\n\nagents classified as solid or hazardous waste pursuant to the\n\nOklahoma Environmental Quality Code.","path":["OK Code","Title 63"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os63.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"15913c559696849f11227cf2b8bf632e9f999dd50e4249bc3cf6595ccc982fd5","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-63-63-122.1","next":"us-ok/okla.-stat.-tit.-63-63-123.1"},"notice":"GroundRules: Original legal text.
