The provisions of the Oklahoma Explosives and Blasting\n\nRegulation Act shall not apply to:\n\na. persons engaged in shooting wells or seismographic\n\noperations for the purpose of oil or gas production,\n\nb. mining operations regulated by Title 45 of the\n\nOklahoma Statutes, and\n\nc. persons using explosives or blasting agents for\n\nnoncommercial use on their own land, owned in fee or\n\nby contract, for the removal of trees, rocks and dams\n\nor for other normal agricultural purposes.\n\n2. Any person exempted from the provisions of the Oklahoma\n\nExplosives and Blasting Regulation Act pursuant to this subsection\n\nshall be liable for all damages caused by the use of explosives, or\n\nblasting agents and blasting operations, which damages shall be\n\nrecoverable in any court of competent jurisdiction.\n\nB. In addition, the provisions of the Oklahoma Explosives and\n\nBlasting Regulation Act shall not apply to:\n\n1. Any municipalities or counties in this state using any\n\nblasting agents, explosives or conducting, supervising or\n\ncontrolling a blasting operation in this state. Any such\n\nmunicipality or county shall comply with rules promulgated by the\n\nOklahoma Mining Commission;\n\n2. The Department of Transportation in the conducting,\n\nsupervision or controlling of any blasting operation in this state,\n\nprovided the Department shall comply with rules promulgated by the\n\nOklahoma Mining Commission; and\n\n3. Duly qualified and certified bomb technicians of a federally\n\naccredited bomb squad of municipal, county, state, and federal law\n\nenforcement agencies for the transportation, storage or disposal of\n\nany explosive chemical, compound or device, when such technician is\n\nperforming responsibilities for the preservation of public peace,\n\nsafety, or criminal investigation.\n\n4. Any employee of the Oklahoma Department of Agriculture,\n\nFood, and Forestry and the United States Department of Agriculture,\n\nAnimal and Plant Health Inspection Service, Wildlife Services who is\n\ntrained and certified by the United States Department of Agriculture\n\nin the safe handling and use of explosive materials in the course of\n\nthe official duties of the employee.","path":["OK Code","Title 63"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os63.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"aa2a89b590c1a6864737146347e8295ef91a5ce829dfeb6fb94632e04a040527","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-63-63-123.7","next":"us-ok/okla.-stat.-tit.-63-63-124"},"notice":"GroundRules: Original legal text.
