Stat. tit. 63, § 63-142.2","heading":"Definitions","body":"As used in the Oklahoma Underground Facilities Damage Prevention\n\nAct:\n\n1. \"Certified project\" means a project where the public agency\n\nresponsible for the public project, in consultation with the\n\nstatewide one-call notification center, as part of its procedure,\n\ncertifies that the project right-of-way is free and clear of\n\nunderground facilities or wherein the public agency responsible for\n\nsuch project, as part of its procedure, notifies all persons\n\ndetermined by the public agency to have underground facilities\n\nlocated within the construction right-of-way and certifies that all\n\nknown underground facilities are duly located or noted on the\n\nengineering drawings for the project;\n\n2. \"Damage\" means any impact upon or removal of support from an\n\nunderground facility as a result of explosion, excavation or\n\ndemolition which according to the operating practices of the\n\noperator of the underground facilities would necessitate the repair\n\nthereof;\n\n3. \"Demolish\" means to wreck, raze, render, move or remove a\n\nstructure by means of any equipment or explosive;\n\n4. \"Demolition\" means the act or operation of demolishing a\n\nstructure;\n\n5. \"Excavate\" means to dig, compress or remove earth, rock or\n\nother materials in or on the ground by use of mechanized equipment\n\nor blasting, including, but not necessarily limited to, augering,\n\nboring, backfilling, drilling, grading, pile driving, plowing in,\n\npulling in, trenching, tunneling and plowing; provided, however,\n\nthat neither:\n\na. the moving of earth by tools manipulated only by human\n\nor animal power, except in a private or public\n\neasement or right-of-way,\n\nb. the moving of earth by tools manipulated only by human\n\npower for burying communication lines of a\n\ncommunications provider in a private or public\n\neasement or right-of-way when depth is not greater\n\nthan twelve (12) inches and within twelve (12) inches\n\nof a communications provider terminal,\n\nc. any form of cultivation for agricultural purposes, nor\n\nany augering, dozing by noncommercial dozer operators\n\nor digging for postholes, farm ponds, land clearing or\n\nother normal agricultural purposes,\n\nd. routine maintenance,\n\ne. work by a public agency or its contractors on a\n\npreengineered project,\n\nf. work on a certified project,\n\ng. work on a permitted project,\n\nh. the opening of a grave in a cemetery,\n\ni. a solid waste disposal site which is a preengineered\n\nproject,\n\nj. any individual excavating on his or her own property\n\nand who is not in the excavating business for hire,\n\nexcept in a private or public easement or right-of-\n\nway, nor\n\nk. any grading or maintenance of county roads that does\n\nnot change either the existing road grade or ditch\n\nflow line,\n\nshall be deemed excavation;\n\n6. \"Excavation\" means the act or operation of excavating;\n\n7. \"Excavator\" means a person or public agency that intends to\n\nexcavate or demolish within this state;\n\n8. \"Notification center\" means the statewide center currently\n\nknown as the Oklahoma One-Call System, Inc., which has as one of its\n\npurposes to receive notification of planned excavation and\n\ndemolition in a specified area from excavators, and to disseminate\n\nsuch notification of planned excavation or demolition to operators\n\nwho are members and participants;\n\n9. \"Operator\" shall mean and include any person or public\n\nagency owning or operating underground facilities;\n\n10. \"Permitted project\" means a project where a permit for the\n\nwork to be performed must be issued by a state or federal agency\n\nand, as a prerequisite to receiving such permit, the applicant must\n\nlocate all underground facilities in the area of the work and in the\n\nvicinity of any blasting and notify each owner of such underground\n\nfacilities;\n\n11. \"Person\" includes any individual, partnership, corporation,\n\nassociation, cooperative, trust or other entity, including a person\n\nengaged as a contractor by a public agency, but not including a\nisite to receiving such permit, the applicant must\n\nlocate all underground facilities in the area of the work and in the\n\nvicinity of any blasting and notify each owner of such underground\n\nfacilities;\n\n11. \"Person\" includes any individual, partnership, corporation,\n\nassociation, cooperative, trust or other entity, including a person\n\nengaged as a contractor by a public agency, but not including a\n\npublic agency;\n\n12. \"Preengineered project\" means a public project wherein the\n\npublic agency responsible for such project, as part of its\n\nengineering and contract procedures, holds a meeting prior to the\n\ncommencement of any construction work on such project in which all\n\npersons, determined by the public agency, in consultation with the\n\nstatewide one-call notification center, to have underground\n\nfacilities located within the construction area of the project are\n\ninvited to attend and given an opportunity to verify or inform the\n\npublic agency of the location of their underground facilities, if\n\nany, within the construction area and where the location of all\n\nknown underground facilities are duly located or noted on the\n\nengineering drawing and specifications for the project;\n\n13. \"Public agency\" means the state, or any board, commission,\n\nor agency of the state;\n\n14. \"Routine maintenance\" means the grading of roads and barrow\n\nor drainage ditches, the removal and replacement of pavement,\n\nincluding excavation relating thereto and the installation and\n\nmaintenance of drainage and bridge facilities, signs, guardrails,\n\nand electrical and communications facilities in or on the public\n\nrights-of-way by a public agency;\n\n15. \"Underground facility\" means any underground line, cable,\n\nfacility, system and appurtenances thereto, for producing, storing,\n\nconveying, transmitting or distributing communication (including\n\nvoice, video, or data information), electricity, power, light, heat,\n\nintrastate and interstate gas pipelines, as described in 49 CFR Part\n\n192.1, intrastate and interstate hazardous liquid or carbon dioxide\n\npipelines, as described in 49 CFR Part 195.1, water (including storm\n\nwater), steam, sewage and other commodities and any oil and gas\n\npipeline located in a private or public easement or right-of-way;\n\n16. \"Design\" or \"survey\" means a notice to facility operators\n\nto provide underground facility information during the design or\n\nengineering phase of a project to mitigate potential impact to\n\nexisting underground facilities;\n\n17. \"Watch and protect\" means an operator or its designated\n\nrepresentative is present to observe an excavation within ten (10)\n\nfeet of the operator's marking of its existing underground facility;\n\n18. \"Pre-excavation meeting request\" means a notice to\n\nunderground facility operators to participate in scheduled meetings\n\nfor the purpose of planning large projects and coordinate resources\n\naccordingly; and\n\n19. \"Large projects\" are those excavation projects that involve\n\none of the following:\n\na. exceeds distances defined in paragraph 5 of subsection\n\nD of Section 142.6 of this title, or\n\nb. estimated duration is more than ninety (90) days.","path":["OK Code","Title
