Stat. tit. 63, § 63-142.9a","heading":"Damage to underground facilities – Liability -","body":"Injunction.\n\nA. Any excavator, except for a public agency who fails to\n\ncomply with the Oklahoma Underground Facilities Damage Prevention\n\nAct and who damages an underground facility owned or operated by a\n\nnonprofit rural water corporation organized pursuant to Section 863\n\nof Title 18 of the Oklahoma Statutes or a rural water district\n\norganized pursuant to the Rural Water, Sewer, Gas, and Solid Waste\n\nManagement Districts Act, shall be liable for the underground damage\n\nto and responsible for the repair of such facilities. Any new\n\nunderground facilities installed on and after September 1, 1992,\n\nshall contain materials capable of being detected so that the\n\nfacilities can be accurately located.\n\nB. Any excavator who damages or cuts an underground facility,\n\nas a result of negligently failing to comply with the provisions of\n\nthe Oklahoma Underground Facilities Damage Prevention Act or as a\n\nresult of failing to take measures for the protection of an\n\nunderground facility shall be liable to the operator of the\n\nunderground facility for the repair of the damaged underground\n\nfacility.\n\nC. Except for public agencies, any excavator who by willful act\n\nor by reckless disregard of the rights of others, repeatedly\n\nviolates the provisions of the Oklahoma Underground Facilities\n\nDamage Prevention Act and repeatedly damages underground facilities,\n\nthereby threatening the public health, safety, and welfare, may be\n\nenjoined by a court of competent jurisdiction from further\n\nexcavation.","path":["OK Code","Title 63"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os63.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"3594220a00ee9b41eb937ae4d410e67fb40c8487607808536a0f4d139642d242","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-63-63-142.9","next":"us-ok/okla.-stat.-tit.-63-63-2-1001"},"notice":"GroundRules: Original legal text.
