As used in this section:\n\n1. \"Glass tube\" means an object which meets all of the\n\nfollowing requirements:\n\na. a hollow glass cylinder, either open or closed at\n\neither end,\n\nb. not less than two (2) nor more than seven (7) inches\n\nin length,\n\nc. not less than one-eighth (1/8) inch nor more than\n\nthree-fourths (3/4) inch in diameter,\n\nd. may be used to facilitate, or intended or designed to\n\nfacilitate, violations of the Uniform Controlled\n\nDangerous Substances Act including, but not limited\n\nto, processing, preparing, testing, analyzing,\n\npackaging, repackaging, storing, containing, and\n\nconcealing controlled substances and injecting,\n\ningesting, inhaling, or otherwise introducing\n\ncontrolled substances into the human body, and\n\ne. sold individually, or in connection with another\n\nobject such as a novelty holder, flower vase, or pen.\n\nThe foregoing descriptions are intended to be\n\nillustrative and not exclusive;\n\n2. “Patron” means a person who enters a business for the\n\npurpose of purchasing or viewing as a shopper, merchandise offered\n\nfor sale at the business; and\n\n3. \"Retailer\" means a person, corporation, or partnership\n\nprimarily engaged in the sale of consumable goods and services\n\nincluding, but not limited to, food and gasoline, at retail to the\n\ngeneral public. A retailer shall not include any person,\n\ncorporation, or partnership that sells specialized laboratory\n\nequipment for research or educational purposes.\n\nB. It shall be unlawful for a retailer within the State of\n\nOklahoma to offer for retail sale to any patron a glass tube, as\n\ndefined in subsection A of this section.\n\nC. A retailer, or an employee of the retailer, who willfully\n\nand knowingly violates the provisions of subsection B of this\n\nsection shall, upon conviction, be guilty of a misdemeanor\n\npunishable by incarceration in the county jail for not more than one\n\n(1) year, or by a fine of not less than One Thousand Dollars\n\n($1,000.00), or by both such fine and imprisonment.\n\nD.
