The Director shall be appointed by the Oklahoma State Bureau\n\nof Narcotics and Dangerous Drugs Control Commission. The Director\n\nof the Oklahoma State Bureau of Narcotics and Dangerous Drugs\n\nControl on January 1, 1984, shall be initially appointed as\n\nDirector. The succeeding Director shall, at the time of the\n\nappointment, have a Bachelor's Degree from an accredited college or\n\nuniversity and at least five (5) years of experience in drug law\n\nenforcement. The Director may appoint necessary assistants, agents,\n\nand other personnel to perform the work of the office and may\n\nprescribe their titles and duties and fix their compensation\n\npursuant to Merit System rules. The Director may appoint employees\n\nto the positions of Chief of Law Enforcement Information and\n\nTechnology, Public Information/Education Officer, Training Officer,\n\nProgram Administrators, Grants Administrator, Criminal Analysts,\n\nLegal Secretary, and Typist Clerk/Spanish Transcriptionists. The\n\npositions shall be unclassified and exempt from the rules and\n\nprocedures of the Office of Management and Enterprise Services,\n\nexcept leave regulations. The office of the Director shall be\n\nlocated at a suitable place in Oklahoma City, Oklahoma.\n\nB. 1. Agents appointed by the Director shall have the powers\n\nof peace officers generally; provided, the Director may appoint\n\nspecial agents and reserve special agents, who shall be unclassified\n\nemployees of the state, to meet specific investigatory needs.\n\nSpecial agents and reserve special agents shall not be required to\n\nmeet the age and educational requirements as specified in this\n\nsection.\n\n2. Agents appointed on and after November 1, 1998, shall be at\n\nleast twenty-one (21) years of age and shall have a Bachelor's\n\nDegree from an accredited college or university.\n\n3. Each entering agent, with the exception of special agents,\n\nshall be required to serve one (1) year in a probationary status as\n\na prerequisite to being placed on permanent status.\n\nC. Agents appointed pursuant to the provisions of this section\n\nshall have the responsibility of investigating alleged violations\n\nand shall have the authority to arrest those suspected of having\n\nviolated the provisions of the Uniform Controlled Dangerous\n\nSubstances Act, as well as the crimes of money laundering and human\n\ntrafficking, as otherwise set forth by laws of this state.\n\nD. The Director may appoint reserve special agents who shall\n\nnot be considered employees of the state and shall serve at the will\n\nof the Director. Reserve special agents shall complete a minimum of\n\ntwo hundred forty (240) hours of training pursuant to Section 3311\n\nof Title 70 of the Oklahoma Statutes and may not serve more than one\n\nhundred forty (140) hours per calendar month. Upon completion of\n\ntraining, reserve special agents appointed by the Director shall\n\nhave general peace officer powers and the authority to arrest those\n\nsuspected of having violated the provisions of the Uniform\n\nControlled Dangerous Substances Act. The agency may expend funds\n\nrelated to training and special reserve agents may receive travel\n\nexpenses pursuant to the State Travel Reimbursement Act.\n\nE. A commissioned employee of the Oklahoma State Bureau of\n\nNarcotics and Dangerous Drugs Control shall be entitled to receive,\n\nupon retirement by reason of length of service, the continued\n\ncustody and possession of the sidearm and badge carried by such\n\nemployee immediately prior to retirement. In addition to the\n\nsidearm carried by the commissioned employee immediately prior to\n\nretirement, the commissioned employee may purchase the rifle or\n\nshotgun, or both, issued to the commissioned employee immediately\n\nprior to retirement upon approval from the Director. The cost to\n\nby such\n\nemployee immediately prior to retirement. In addition to the\n\nsidearm carried by the commissioned employee immediately prior to\n\nretirement, the commissioned employee may purchase the rifle or\n\nshotgun, or both, issued to the commissioned employee immediately\n\nprior to retirement upon approval from the Director. The cost to\n\nthe commissioned employee of purchasing the firearm shall be the\n\nstate-approved firearms vendor trade-in value, and upon payment of\n\nthat price, the commissioned employee shall be entitled to ownership\n\nof the firearm. Any records regarding the ownership of each firearm\n\ntransferred shall be modified to reflect the transfer to the\n\ncommissioned employee. Proceeds from the purchase of the firearm\n\nshall be deposited in the Bureau of Narcotics Revolving Fund\n\nestablished pursuant to Section 2-107 of this title.\n\nF. A commissioned employee of the Bureau may be entitled to\n\nreceive, upon retirement by reason of disability, the continued\n\ncustody and possession of the sidearm and badge carried by such\n\nemployee immediately prior to retirement upon written approval of\n\nthe Director.\n\nG. Custody and possession of the sidearm and badge of a\n\ncommissioned employee killed in the line of duty may be awarded by\n\nthe Director to the spouse or next of kin of the deceased employee.\n\nH. Custody and possession of the sidearm and badge of a\n\ncommissioned employee who dies while employed at the Oklahoma State\n\nBureau of Narcotics and Dangerous Drugs Control may be awarded by\n\nthe Director to the spouse or next of kin of the deceased employee.\n\nI. Any Director appointed on or after July 1, 2003, shall be\n\neligible to participate in either the Oklahoma Public Employees\n\nRetirement System or in the Oklahoma Law Enforcement Retirement\n\nSystem and shall make an irrevocable election in writing to\n\nparticipate in one of the two retirement systems.\n\nJ. Any employee of the Oklahoma State Bureau of Narcotics and\n\nDangerous Drugs Control in a classified position under the Merit\n\nSystem of the Personnel Administration who is appointed Director,\n\nDeputy Director, Acting Director or Acting Deputy Director shall\n\nhave a right to return to the highest previously held classified\n\nposition without any loss of rights, privileges or benefits\n\nimmediately upon completion of the duties of the employee, provided\n\nthe employee is not otherwise disqualified.","path":["OK Code","Title 63"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os63.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"0cf46b0f65cabd9bb19f5c969a743866e2ce228f5f697c2def119174aad98528","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-63-63-2-102","next":"us-ok/okla.-stat.-tit.-63-63-2-103.1"},"notice":"GroundRules: Original legal text.
