Until July 1, 2026, the following are hereby authorized to\n\nengage in harm-reduction services:\n\n1. Government entities including, but not limited to, the State\n\nDepartment of Health and the Department of Mental Health and\n\nSubstance Abuse Services; provided, no state dollars shall be used\n\nto purchase hypodermic needles;\n\n2. Religious institutions or churches;\n\n3. Nonprofit organizations;\n\n4. For-profit companies;\n\n5. Nongovernment entities partnering with a governmental\n\nagency; and\n\n6. Tribal governments.\n\nB. Those offering harm-reduction services shall register with\n\nthe State Department of Health and may engage in the following\n\nactivities in order to reduce the use of drugs, prevent outbreaks of\n\ninfectious diseases and reduce morbidity among people who use\n\ninjection drugs:\n\n1. Offer referrals and resources to treat substance use\n\ndisorders;\n\n2. Provide education on the risk of transmission of infectious\n\ndiseases, including human immunodeficiency virus (HIV) and viral\n\nhepatitis;\n\n3. Rapid testing for HIV, hepatitis C and sexually transmitted\n\ninfections (STIs);\n\n4. Referrals for medical and mental health services;\n\n5. Collect used hypodermic needles for safe disposal;\n\n6. Possess and distribute hypodermic needles, cleaning kits,\n\ntest kits and opioid antagonists; and\n\n7. Rapid substance testing products used, intended for use, or\n\nfashioned specifically for the use in identifying or analyzing the\n\npotency or toxicity of unknown substances.\n\nC. Registered providers of harm-reduction services shall report\n\nat least quarterly to the State Department of Health:\n\n1. The number of clients served including basic demographic\n\ninformation;\n\n2. Number and type of referrals provided;\n\n3. Number of syringes, test kits and antagonists distributed;\n\n4. Number of used syringes collected; and\n\n5. Number of rapid HIV and viral hepatitis tests performed\n\nincluding the number of reactive test results.\n\nD.
