Any material, compound, mixture, or preparation which\n\ncontains any quantity of the following substances having a potential\n\nfor abuse associated with a stimulant or depressant effect on the\n\ncentral nervous system:\n\n1. Chloral betaine;\n\n2. Chloral hydrate;\n\n3. Ethchlorvynol;\n\n4. Ethinamate;\n\n5. Meprobamate;\n\n6. Paraldehyde;\n\n7. Petrichloral;\n\n8. Diethylpropion;\n\n9. Phentermine;\n\n10. Pemoline;\n\n11. Chlordiazepoxide;\n\n12. Chlordiazepoxide and its salts, but not including\n\nchlordiazepoxide hydrochloride and clidinium bromide or\n\nchlordiazepoxide and water-soluble esterified estrogens;\n\n13. Diazepam;\n\n14. Oxazepam;\n\n15. Clorazepate;\n\n16. Flurazepam and its salts;\n\n17. Clonazepam;\n\n18. Barbital;\n\n19. Mebutamate;\n\n20. Methohexital;\n\n21. Methylphenobarbital;\n\n22. Phenobarbital;\n\n23. Fenfluramine;\n\n24. Pentazocine;\n\n25. Propoxyphene;\n\n26. Butorphanol;\n\n27. Alprazolam;\n\n28. Halazepam;\n\n29. Lorazepam;\n\n30. Prazepam;\n\n31. Temazepam;\n\n32. Triazolam;\n\n33. Carisoprodol;\n\n34. Dichloralphenazone;\n\n35. Estazolam;\n\n36. Eszopiclone;\n\n37. Midazolam;\n\n38. Modafinil;\n\n39. Zaleplon;\n\n40. Zolpidem;\n\n41. Tramadol;\n\n42. Bromazepam;\n\n43. Suvorexant;\n\n44. Phenazepam;\n\n45. Etizolam; or\n\n46. Clonazolam.\n\nB. 1. The following nonnarcotic substances, which may, under\n\nthe Federal Food, Drug, and Cosmetic Act (21 U.S.C., Section 301),\n\nbe lawfully sold over the counter without a prescription, are\n\nexcluded from all schedules of controlled substances under this\n\ntitle:\n\na. Breathe-Aid,\n\nb. BronCare,\n\nc. Bronchial Congestion,\n\nd. Bronkaid Tablets,\n\ne. Bronkaid Dual Action Caplets,\n\nf. Bronkotabs,\n\ng. Bronkolixir,\n\nh. NeoRespin,\n\ni. Pazo Hemorrhoid Ointment and Suppositories,\n\nj. Primatene Tablets,\n\nk. Primatene \"Dual Action\" Formula,\n\nl. Quelidrine,\n\nm. Resp, and\n\nn. Vatronal Nose Drops.\n\n2. At the request of any person, the Director may exempt any\n\nother drug product containing ephedrine from being included as a\n\nSchedule IV controlled substance if such product:\n\na. is labeled and marketed in a manner consistent with\n\nthe pertinent OTC tentative final or final monograph\n\nissued by the FDA, and\n\nb. is manufactured and distributed for legitimate\n\nmedicinal use and in a manner that reduces or\n\neliminates the likelihood of abuse.\n\n3. In making a determination regarding a drug product, the\n\nDirector, after notice and hearing, shall consider the following:\n\na. the history and current pattern of abuse,\n\nb. the name and labeling of the product,\n\nc. the intended manner of distribution, advertising and\n\npromotion of the product, and\n\nd. other factors as may be relevant to and consistent\n\nwith the public health and safety.\n\n4. The hearing shall be held in accordance with the\n\nAdministrative Procedures Act.\n\n5. A list of current drug products meeting exemption\n\nrequirements under this subsection may be obtained from the Bureau\n\nupon written request.\n\nC. The Board of Pharmacy may except by rule any compound,\n\nmixture, or preparation containing any depressant substance listed\n\nin subsection A of this section from the application of all or any\n\npart of the Uniform Controlled Dangerous Substances Act, Section 2-\n\n101 et seq. of this title, if the compound, mixture, or preparation\n\ncontains one or more active medicinal ingredients not having a\n\ndepressant effect on the central nervous system, and if the\n\nadmixtures are included therein in combinations, quantity,\n\nproportion, or concentration that vitiate the potential for abuse of\n\nthe substances which have a depressant effect on the central nervous\n\nsystem.","path":["OK Code","Title 63"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os63.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"a2950cb10930cea4a524fa448be7c5a6334d14b1f3b7873c9c31c3717d5a4fd1","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-63-63-2-209","next":"us-ok/okla.-stat.-tit.-63-63-2-211"},"notice":"GroundRules: Original legal text.
