The controlled substances listed in this section are\n\nincluded in Schedule V.\n\n1. Any compound, mixture, or preparation containing limited\n\nquantities of any of the following narcotic drugs, which also\n\ncontains one or more nonnarcotic active medicinal ingredients in\n\nsufficient proportion to confer upon the compound, mixture, or\n\npreparation, valuable medicinal qualities other than those possessed\n\nby the narcotic drug alone:\n\na. not more than two hundred (200) milligrams of codeine,\n\nor any of its salts, per one hundred (100) milliliters\n\nor per one hundred (100) grams,\n\nb. not more than one hundred (100) milligrams of\n\ndihydrocodeine, or any of its salts, per one hundred\n\n(100) milliliters or per one hundred (100) grams,\n\nc. not more than one hundred (100) milligrams of\n\nethylmorphine, or any of its salts, per one hundred\n\n(100) milliliters or per one hundred (100) grams,\n\nd. not more than two and five-tenths (2.5) milligrams of\n\ndiphenoxylate and not less than twenty-five (25)\n\nmicrograms of atropine sulfate per dosage unit, or\n\ne. not more than one hundred (100) milligrams of opium\n\nper one hundred (100) milliliters or per one hundred\n\n(100) grams.\n\n2. Any compound, mixture, or preparation containing any\n\ndetectable quantity of base pseudoephedrine or ephedrine, its salts\n\nor optical isomers, or salts of optical isomers. If any compound,\n\nmixture, or preparation as specified in this paragraph is dispensed,\n\nsold, or distributed in a pharmacy:\n\na. it shall be dispensed, sold, or distributed only by,\n\nor under the supervision of, a licensed pharmacist or\n\na registered pharmacy technician,\n\nb. a service charge not to exceed the purchase price of\n\nthe product, mixture or preparation may be assessed\n\nand collected by the licensed pharmacist or registered\n\npharmacy technician at the point of sale from the\n\nperson seeking to purchase, receive or otherwise\n\nacquire a pseudoephedrine product or products. Upon\n\nreceipt of payment of the service charge, the licensed\n\npharmacist or registered pharmacy technician shall\n\naccess the methamphetamine offender registry and\n\nverify whether the person is an individual who is\n\nlisted on the methamphetamine offender registry. Upon\n\nverification that the person is an individual who is\n\nnot listed on the methamphetamine offender registry,\n\nthe service charge shall be deducted from the total\n\npurchase price of the pseudoephedrine product or\n\nproducts. Upon verification that the person is an\n\nindividual who is listed on the methamphetamine\n\noffender registry, the person shall be prohibited from\n\npurchasing the pseudoephedrine product or products and\n\nshall be required to forfeit the service charge\n\npreviously collected by the licensed pharmacist or\n\nregistered pharmacy technician. Any pharmacy that\n\nrequires the assessment and collection of a service\n\ncharge for pseudoephedrine products shall post a clear\n\nand conspicuous sign at each public entrance to the\n\nplace of business and at each register within the\n\npharmacy that provides notice to customers of the\n\npharmacy that a service charge shall be assessed and\n\ncollected for pseudoephedrine products and, upon\n\nverification that the person is listed on the\n\nmethamphetamine offender registry, the service charge\n\nshall be forfeited and retained by the pharmacy, and\n\nc. any person who is not an individual listed on the\n\nmethamphetamine offender registry that is purchasing,\n\nreceiving, or otherwise acquiring any compound,\n\nmixture, or preparation shall produce a driver\n\nlicense, passport, military identification, or other\n\nstate-issued identification card and shall sign a\n\nwritten or electronic log, receipt, or other program\n\nor mechanism approved by the Oklahoma Bureau of\n\nNarcotics and Dangerous Drugs Control, showing:\n\n(1) the date and time of the transaction,\n\n(2) name, address and date of birth of the purchaser,\nmilitary identification, or other\n\nstate-issued identification card and shall sign a\n\nwritten or electronic log, receipt, or other program\n\nor mechanism approved by the Oklahoma Bureau of\n\nNarcotics and Dangerous Drugs Control, showing:\n\n(1) the date and time of the transaction,\n\n(2) name, address and date of birth of the purchaser,\n\n(3) driver license number, passport, military\n\nidentification, or state-issued identification\n\nnumber and state of residence of the purchaser,\n\n(4) name and initials of the pharmacist or pharmacy\n\ntechnician conducting the transaction,\n\n(5) the product being sold,\n\n(6) total quantity, in grams, of base pseudoephedrine\n\nor ephedrine purchased, and\n\n(7) attestation by the person receiving the compound,\n\nmixture or preparation that the person is not\n\nsubject to the Methamphetamine Offender Registry\n\nAct.\n\nNo person shall purchase, receive, or otherwise acquire more\n\nthan three and six-tenths (3.6) grams of any product, mixture, or\n\npreparation per day or more than seven and two-tenths (7.2) grams of\n\nany product, mixture, or preparation within any thirty-day period,\n\nor sixty (60) grams of any product, mixture, or preparation within a\n\ntwelve-month period. Once a person has purchased, received or\n\notherwise acquired the daily limit of three and six-tenths (3.6)\n\ngrams of any product, mixture or preparation, the person shall be\n\nprohibited from purchasing, receiving or otherwise acquiring any\n\nadditional product, mixture or preparation containing any detectable\n\nquantity of base pseudoephedrine or ephedrine for a period of not\n\nless than seventy-two (72) hours following the last permitted\n\npurchase. The requirements of this paragraph shall not apply to any\n\nquantity of such product, mixture or preparation dispensed pursuant\n\nto a valid prescription. There shall be no protocol or procedure\n\nmandated by any individual or corporate entity that interferes with\n\nthe professional duty of a pharmacist to counsel and evaluate the\n\nappropriate pharmaceutical needs of a patient and the exercise of\n\nthe professional judgment of a pharmacist as to whether it is\n\nappropriate to dispense medication as set forth in this paragraph or\n\notherwise.\n\n3. Any compound, mixture, or preparation containing any\n\ndetectable quantity of pregabalin.\n\nB. The Director of the Oklahoma State Bureau of Narcotics and\n\nDangerous Drugs Control, by rule, may exempt other products from\n\nthis Schedule which the Director finds are not used in the illegal\n\nmanufacture of methamphetamine or other controlled dangerous\n\nsubstances.
