Every person who manufactures, distributes, dispenses,\n\nprescribes, administers or uses for scientific purposes any\n\ncontrolled dangerous substance within or into this state, or who\n\nproposes to engage in the manufacture, distribution, dispensing,\n\nprescribing, administering or use for scientific purposes of any\n\ncontrolled dangerous substance within or into this state shall\n\nobtain a registration issued by the Director of the Oklahoma State\n\nBureau of Narcotics and Dangerous Drugs Control, in accordance with\n\nrules promulgated by the Director. Persons registered by the\n\nDirector under Section 2-101 et seq. of this title to manufacture,\n\ndistribute, dispense or conduct research with controlled dangerous\n\nsubstances may possess, manufacture, distribute, dispense or conduct\n\nresearch with those substances to the extent authorized by their\n\nregistration and in conformity with the other provisions of the\n\nUniform Controlled Dangerous Substances Act. Every wholesaler,\n\nmanufacturer or distributor of any drug product containing\n\npseudoephedrine or phenylpropanolamine, or their salts, isomers or\n\nsalts of isomers, shall obtain a registration issued by the Director\n\nof the Oklahoma State Bureau of Narcotics and Dangerous Drugs\n\nControl in accordance with rules promulgated by the Director and as\n\nprovided for in Section 2-332 of this title. Any person who\n\nmanufactures, distributes, dispenses, prescribes, administers or\n\nuses for scientific purposes any controlled dangerous substances\n\nwithin or into this state without first obtaining a registration\n\nissued by the Director of the Oklahoma State Bureau of Narcotics and\n\nDangerous Drugs Control shall be subject to the same statutory and\n\nadministrative jurisdiction of the Director as if that person were\n\nan applicant or registrant.\n\nB. Out-of-state pharmaceutical suppliers who provide controlled\n\ndangerous substances to individuals within this state shall obtain a\n\nregistration issued by the Director of the Oklahoma State Bureau of\n\nNarcotics and Dangerous Drugs Control, in accordance with rules\n\npromulgated by the Director. This provision shall also apply to\n\nwholesale distributors who distribute controlled dangerous\n\nsubstances to pharmacies or other entities registered within this\n\nstate in accordance with rules promulgated by the Director.\n\nC. Every person who owns in whole or in part a public or\n\nprivate medical facility for which a majority of patients are issued\n\non a reoccurring monthly basis a prescription for opioids,\n\nbenzodiazepines, barbiturates or carisoprodol, but not including\n\nbuprenorphine with naloxone or buprenorphine as used for medication-\n\nassisted treatment services, shall obtain a registration issued by\n\nthe Director of the Oklahoma State Bureau of Narcotics and Dangerous\n\nDrugs Control.\n\nD. Every manufacturer and distributor required to register\n\nunder the provisions of this section shall provide all data required\n\npursuant to 21 U.S.C., Section 827(d)(1) on a monthly basis to the\n\nOklahoma State Bureau of Narcotics and Dangerous Drugs Control.\n\nControlled dangerous substances in Schedule I shall be reported in\n\naccordance with rules promulgated by the Director. Reporting of\n\ncontrolled dangerous substances pursuant to 21 U.S.C., Section\n\n827(d)(1) shall include, but not be limited to:\n\n1. The manufacturer’s or distributor’s name, address, phone\n\nnumber, DEA registration number and controlled dangerous substance\n\nregistration number issued by the Bureau;\n\n2. The name, address and DEA registration number of the entity\n\nto whom the controlled dangerous substance was sold;\n\n3. The date of the sale of the controlled dangerous substance;\n\n4. The name and National Drug Code of the controlled dangerous\n\nsubstance sold; and\n\n5. The number of containers and the strength and quantity of\n\ncontrolled dangerous substances in each container sold.\nby the Bureau;\n\n2. The name, address and DEA registration number of the entity\n\nto whom the controlled dangerous substance was sold;\n\n3. The date of the sale of the controlled dangerous substance;\n\n4. The name and National Drug Code of the controlled dangerous\n\nsubstance sold; and\n\n5. The number of containers and the strength and quantity of\n\ncontrolled dangerous substances in each container sold.\n\nE. The information maintained and provided pursuant to\n\nsubsection D of this section shall be confidential and not open to\n\nthe public. Access to the information shall, at the discretion of\n\nthe Director, be limited to:\n\n1. Peace officers certified pursuant to the provisions of\n\nSection 3311 of Title 70 of the Oklahoma Statutes who are employed\n\nas investigative agents of the Oklahoma State Bureau of Narcotics\n\nand Dangerous Drugs Control or the Office of the Attorney General;\n\n2. The United States Drug Enforcement Administration Diversion\n\nGroup Supervisor; and\n\n3. A multicounty grand jury properly convened pursuant to the\n\nprovisions of the Multicounty Grand Jury Act.\n\nF. Manufacturers, distributors, home care agencies, hospices,\n\nhome care services, medical facility owners referred to in\n\nsubsection C of this section and scientific researchers shall obtain\n\na registration annually. Other practitioners shall obtain a\n\nregistration for a period to be determined by the Director that will\n\nbe for a period not less than one (1) year nor more than three (3)\n\nyears.\n\nG. Every trainer or handler of a canine controlled dangerous\n\nsubstances detector who, in the ordinary course of such trainer’s or\n\nhandler’s profession, desires to possess any controlled dangerous\n\nsubstance, annually, shall obtain a registration issued by the\n\nDirector for a fee of Seventy Dollars ($70.00). Such persons shall\n\nbe subject to all applicable provisions of Section 2-101 et seq. of\n\nthis title and such applicable rules promulgated by the Director for\n\nthose individuals identified in subparagraph a of paragraph 32 of\n\nSection 2-101 of this title. Persons registered by the Director\n\npursuant to this subsection may possess controlled dangerous\n\nsubstances to the extent authorized by their registration and in\n\nconformity with the other provisions of the Uniform Controlled\n\nDangerous Substances Act.\n\nH. The following persons shall not be required to register and\n\nmay lawfully possess controlled dangerous substances under the\n\nprovisions of Section 2-101 et seq. of this title:\n\n1. An agent, or an employee thereof, of any registered\n\nmanufacturer, distributor, dispenser or user for scientific purposes\n\nof any controlled dangerous substance, if such agent is acting in\n\nthe usual course of such agent’s or employee’s business or\n\nemployment;\n\n2. Any person lawfully acting under the direction of a person\n\nauthorized to administer controlled dangerous substances under\n\nSection 2-312 of this title;\n\n3. A common or contract carrier or warehouser, or an employee\n\nthereof, whose possession of any controlled dangerous substance is\n\nin the usual course of such carrier’s or warehouser’s business or\n\nemployment;\n\n4. An ultimate user or a person in possession of any controlled\n\ndangerous substance pursuant to a lawful order of a practitioner;\n\n5. An individual pharmacist acting in the usual course of such\n\npharmacist’s employment with a pharmacy registered pursuant to the\n\nprovisions of Section 2-101 et seq. of this title;\n\n6. A nursing home licensed by this state;\n\n7. Any Department of Mental Health and Substance Abuse Services\n\nemployee or any person whose facility contracts with the Department\n\nof Mental Health and Substance Abuse Services whose possession of\n\nany dangerous drug, as defined in Section 353.1 of Title 59 of the\n\nOklahoma Statutes, is for the purpose of delivery of a mental health\neq. of this title;\n\n6. A nursing home licensed by this state;\n\n7. Any Department of Mental Health and Substance Abuse Services\n\nemployee or any person whose facility contracts with the Department\n\nof Mental Health and Substance Abuse Services whose possession of\n\nany dangerous drug, as defined in Section 353.1 of Title 59 of the\n\nOklahoma Statutes, is for the purpose of delivery of a mental health\n\nconsumer’s medicine to the consumer’s home or residence;\n\n8. Registered nurses and licensed practical nurses; and\n\n9. An assisted living facility licensed by this state.\n\nI. The Director may, by rule, waive the requirement for\n\nregistration or fee for registration of certain manufacturers,\n\ndistributors, dispensers, prescribers, administrators or users for\n\nscientific purposes if the Director finds it consistent with the\n\npublic health and safety.\n\nJ. A separate registration shall be required at each principal\n\nplace of business or professional practice where the applicant\n\nmanufactures, distributes, dispenses, prescribes, administers or\n\nuses for scientific purposes controlled dangerous substances.\n\nK. The Director is authorized to inspect the establishment of a\n\nregistrant or applicant for registration in accordance with rules\n\npromulgated by the Director.\n\nL. No person engaged in a profession or occupation for which a\n\nlicense to engage in such activity is provided by law shall be\n\nregistered under the Uniform Controlled Dangerous Substances Act\n\nunless such person holds a valid license of such person’s profession\n\nor occupation.\n\nM. Registrations shall be issued on the first day of November\n\nof each year and shall expire annually. Registrations may be issued\n\nat other times, however, upon certification of the professional\n\nlicensing board. Registration applications shall be required\n\nannually thereafter.\n\nN. The licensing boards of all professions and occupations to\n\nwhich the use of controlled dangerous substances is incidental shall\n\nfurnish a current list to the Director, not later than the first day\n\nof October of each year, of the persons holding valid licenses. All\n\nsuch persons except persons exempt from registration requirements\n\nunder subsection H of this section shall be subject to the\n\nregistration requirements of Section 2-101 et seq. of this title.\n\nO. The licensing board of any professional defined as a mid-\n\nlevel practitioner shall notify and furnish to the Director, not\n\nlater than the first day of October of each year, that such\n\nprofessional holds a valid license, a current listing of individuals\n\nlicensed and registered with their respective boards to prescribe,\n\norder, select, obtain and administer controlled dangerous\n\nsubstances. The licensing board shall immediately notify the\n\nDirector of any action subsequently taken against any such\n\nindividual.\n\nP. Beginning November 1, 2010, each registrant that prescribes,\n\nadministers or dispenses methadone shall be required to check the\n\nprescription profile of the patient on the central repository of the\n\nOklahoma State Bureau of Narcotics and Dangerous Drugs Control.\n\nQ. All legal entities applying for or approved for registration\n\nshall disclose to the Director all beneficial owners of the legal\n\nentity. Publicly traded entities shall be exempt from full\n\ndisclosure; provided that, the publicly traded entity discloses to\n\nthe Director all beneficial owners who exercise authority or control\n\nover controlled dangerous substances at each registered location.\n\nR. No registration, or any authority conferred thereby, shall\n\nbe leased, assigned, or otherwise transferred.
