The Director of the Oklahoma State Bureau of Narcotics and\n\nDangerous Drugs Control shall register an applicant to own a medical\n\nfacility as described in subsection C of Section 2-302 of this\n\ntitle, or to manufacture, distribute, dispense, prescribe,\n\nadminister or use for scientific purposes controlled dangerous\n\nsubstances included in Schedules I through V of Section 2-101 et\n\nseq. of this title unless the Director determines that the issuance\n\nof such registration is inconsistent with the public interest. In\n\ndetermining the public interest, the following factors shall be\n\nconsidered:\n\n1. Maintenance of effective controls against diversion of\n\nparticular controlled dangerous substances and any Schedule I or II\n\nsubstance compounded therefrom into other than legitimate medical,\n\nscientific or industrial channels including examination of the\n\nfitness of his or her employees or agents to handle dangerous\n\nsubstances;\n\n2. Compliance with applicable state and local law;\n\n3. Has been found guilty of, entered a plea of guilty or nolo\n\ncontendere to a charge under the Uniform Controlled Dangerous\n\nSubstances Act or any other state or federal law relating to any\n\nsubstance defined herein as a controlled dangerous substance or any\n\nfelony under the laws of any state or the United States;\n\n4. Furnishing by the applicant false or fraudulent material\n\ninformation in any application filed under Section 2-101 et seq. of\n\nthis title;\n\n5. Past experience in the manufacture, distribution,\n\ndispensing, prescribing, administering or use for scientific\n\npurposes of controlled dangerous substances, and the existence in\n\nthe establishment of effective controls against diversion;\n\n6. Denial, suspension or revocation of the applicant’s federal\n\nregistration to manufacture, distribute or dispense controlled\n\ndangerous substances as authorized by federal law; and\n\n7. Such other factors as may be relevant to and consistent with\n\nthe public health and safety.\n\nNothing herein shall be deemed to require individual licensed\n\npharmacists to register under the provisions of the Uniform\n\nControlled Dangerous Substances Act.\n\nB. Registration granted under subsection A of this section\n\nshall not entitle a registrant to manufacture, distribute, dispense,\n\nprescribe, administer or use for scientific purposes controlled\n\ndangerous substances in Schedule I or II other than those specified\n\nin the registration.\n\nC. Practitioners shall be registered to dispense, prescribe,\n\nadminister or use for scientific purposes substances in Schedules II\n\nthrough V if they are authorized to carry on their respective\n\nactivities under the laws of this state. A registration application\n\nby a practitioner who wishes to conduct research with Schedule I\n\nsubstances shall be accompanied by evidence of the applicant’s\n\nfederal registration to conduct such activity and shall be referred\n\nto the Medical Research Commission for advice. The Medical Research\n\nCommission shall promptly advise the Director concerning the\n\nqualifications of each practitioner requesting such registration.\n\nRegistration for the purpose of bona fide research or of use for\n\nscientific purposes with Schedule I substances by a practitioner\n\ndeemed qualified by the Medical Research Commission may be denied\n\nonly on a ground specified in subsection A of Section 2-304 of this\n\ntitle or if there are reasonable grounds to believe that the\n\napplicant will abuse or unlawfully transfer such substances or fail\n\nto safeguard adequately such applicant’s supply of such substances\n\nagainst diversion from legitimate medical or scientific use.\n\nD. Fees for registration under this section shall be as\n\nfollows:\n\nPractitioners and mid-level\n\npractitioners $140.00 per year\n\nof registration\n\nHome Care Agencies, Hospices \u0026\n\nHome Care Services $140.00 annually\n\nMedical Facility Owners $300.00 annually\ntances or fail\n\nto safeguard adequately such applicant’s supply of such substances\n\nagainst diversion from legitimate medical or scientific use.\n\nD. Fees for registration under this section shall be as\n\nfollows:\n\nPractitioners and mid-level\n\npractitioners $140.00 per year\n\nof registration\n\nHome Care Agencies, Hospices \u0026\n\nHome Care Services $140.00 annually\n\nMedical Facility Owners $300.00 annually\n\nDistributors $300.00 annually\n\nManufacturers $2,500.00 annually\n\nManufacturer, Wholesaler, or\n\nDistributor of drug products\n\ncontaining pseudoephedrine\n\nor phenylpropanolamine $300.00 annually\n\nE. Compliance by manufacturers and distributors with the\n\nprovisions of the federal Controlled Substances Act, 21 U.S.C.,\n\nSection 801 et seq., respecting registration, excluding fees, shall\n\nbe deemed sufficient to qualify for registration under Section 2-101\n\net seq. of this title.\n\nF. Applications for renewal of registration shall open on the\n\nfirst day of July annually. Applications for renewal shall be\n\nconsidered timely if submitted by the first day of September\n\nannually. Registrations not renewed by the final day of any\n\ncalendar year in which the registration was issued shall be\n\nineligible for renewal and shall require a new registration upon\n\nreturn to the Bureau. With notice provided prior to expiration, the\n\nDirector may waive the requirement of a new registration pursuant to\n\npromulgated rules.
