Stat. tit. 63, § 63-2-304","heading":"Denial, revocation, annulment, or suspension of","body":"registration.\n\nA. A registration, pursuant to Section 2-303 of this title, to\n\nmanufacture, distribute, dispense, prescribe, administer or use for\n\nscientific purposes a controlled dangerous substance shall be\n\nlimited, conditioned, denied, suspended, annulled, or revoked by the\n\nDirector of the Oklahoma State Bureau of Narcotics and Dangerous\n\nDrugs Control upon a finding that the registrant or applicant:\n\n1. Has materially falsified any application filed pursuant to\n\nthe Uniform Controlled Dangerous Substances Act or required by the\n\nUniform Controlled Dangerous Substances Act. It shall be unlawful\n\nto knowingly or intentionally:\n\na. make false statements, include false data or omit\n\nmaterial information on an application for a\n\nregistration with the Oklahoma State Bureau of\n\nNarcotics and Dangerous Drugs Control, or\n\nb. provide false data or omit material information in any\n\nrecords or reports required by rule or law to be\n\ncreated, maintained or submitted to the Bureau;\n\n2. Has been found guilty of, entered a plea of guilty or\n\nentered a plea of nolo contendere to a misdemeanor relating to any\n\nsubstance defined herein as a controlled dangerous substance or any\n\nfelony under the laws of any state or the United States;\n\n3. Has had his or her federal registration retired, suspended\n\nor revoked by a competent federal authority and is no longer\n\nauthorized by federal law to manufacture, distribute, dispense,\n\nprescribe, administer or use for scientific purposes controlled\n\ndangerous substances;\n\n4. Has failed to maintain effective controls against the\n\ndiversion of controlled dangerous substances to unauthorized persons\n\nor entities;\n\n5. Has prescribed, dispensed or administered a controlled\n\ndangerous substance from schedules other than those specified in his\n\nor her state or federal registration;\n\n6. Has had a restriction, suspension, revocation, limitation,\n\ncondition or probation placed on his or her professional license or\n\ncertificate or practice as a result of a proceeding pursuant to the\n\ngeneral statutes;\n\n7. Is abusing or, within the past five (5) years, has abused or\n\nexcessively used drugs or controlled dangerous substances;\n\n8. Has prescribed, sold, administered or ordered any controlled\n\ndangerous substance for an immediate family member, himself or\n\nherself; provided that this shall not apply to a medical emergency\n\nwhen no other doctor is available to respond to the emergency;\n\n9. Has possessed, used, prescribed, dispensed or administered\n\ndrugs or controlled dangerous substances for other than legitimate\n\nmedical or scientific purposes or for purposes outside the normal\n\ncourse of his or her professional practice;\n\n10. Has been under the influence of alcohol or another\n\nintoxicating substance which adversely affected the central nervous\n\nsystem, vision, hearing or other sensory or motor functioning to\n\nsuch degree the person was impaired during the performance of his or\n\nher job; or\n\n11. Has violated any federal law relating to any controlled\n\ndangerous substances, any provision of the Uniform Controlled\n\nDangerous Substances Act or any rules of the Oklahoma State Bureau\n\nof Narcotics and Dangerous Drugs Control.\n\nB. In the event the Director suspends or revokes a registration\n\ngranted under Section 2-303 of this title, all controlled dangerous\n\nsubstances owned or possessed by the registrant pursuant to such\n\nregistration at the time of revocation or suspension or the\n\neffective date of the revocation order, as the case may be, may in\n\nthe discretion of the Director be impounded and preserved. All\n\ncontrolled dangerous substances not impounded or preserved by the\n\nDirector shall be maintained by the registrant. Upon issuance of a\n\nrevocation order, no disposition, purchase, distribution, sale, or\n\ntransfer may be made of controlled dangerous substances until the\n\ntime for taking an appeal has elapsed or until all appeals have been\ne discretion of the Director be impounded and preserved. All\n\ncontrolled dangerous substances not impounded or preserved by the\n\nDirector shall be maintained by the registrant. Upon issuance of a\n\nrevocation order, no disposition, purchase, distribution, sale, or\n\ntransfer may be made of controlled dangerous substances until the\n\ntime for taking an appeal has elapsed or until all appeals have been\n\nconcluded unless a court, upon application therefor, orders the sale\n\nof perishable substances and the deposit of the proceeds of the sale\n\nwith the court to be distributed to the prevailing party. Upon a\n\nrevocation order becoming final, all such controlled dangerous\n\nsubstances shall be forfeited to the state or otherwise submitted\n\nfor destruction in accordance with applicable law and by order of\n\nthe Director.\n\nC.
