Except as otherwise in this act specifically provided, this\n\nact shall not apply to the following cases:\n\n1. Prescribing, administering, dispensing, or selling at retail\n\nnot more than one of any of the following medicinal preparations\n\nthat contain in thirty (30) milliliters or, if a solid or semisolid\n\npreparation, in one (1) avoirdupois ounce:\n\na. not more than one hundred sixty (160) milligrams of\n\nopium;\n\nb. not more than twenty (20) milligrams of morphine or of\n\nany of its salts; or\n\nc. not more than eighty (80) milligrams of codeine or any\n\nof its salts.\n\n2. Prescribing, administering, dispensing, or selling at retail\n\nof liniments, ointments, and other preparations, that are\n\nsusceptible of external use only and that contain narcotic drugs in\n\nsuch combinations as to prevent their being readily extracted from\n\nsuch liniments, ointments, or preparations, except that this act\n\nshall apply to all liniments, ointments and other preparations that\n\ncontain coca leaves in any quantity or combination.\n\nB. The exemptions authorized by subparagraphs 1 and 2 of\n\nsubsection A of this section shall be subject to all of the\n\nconditions set out in this subsection. The exemptions authorized by\n\nsubparagraph 3 of subsection A of this section shall not, however,\n\nbe subject to the conditions set out in subparagraphs 1, 2 or 3 of\n\nthis subsection, but shall be subject to subparagraph 4 of this\n\nsubsection.\n\n1. No person shall prescribe, administer, dispense, or\n\ndistribute under the exemptions of this section, to any one person,\n\nor for the use of any one person or animal, any preparation or\n\npreparations included within this section, when he knows, or can by\n\nreasonable diligence ascertain, that such prescribing,\n\nadministering, dispensing or distributing will provide the persons\n\nto whom or for whose use, or the owner of the animal for the use of\n\nwhich such preparation is prescribed, administered, dispensed, or\n\ndistributed, within any forty-eight (48) consecutive hours, with\n\nmore than three hundred twenty (320) milligrams of opium, or more\n\nthan forty (40) milligrams of morphine or any of its salts, or more\n\nthan one hundred sixty (160) milligrams of codeine or any of its\n\nsalts, or will provide such person or the owner of such animal,\n\nwithin forty-eight (48) consecutive hours, with more than one\n\npreparation exempted by this section from the operation of this act.\n\n2. This act shall not apply to any compound, mixture or\n\npreparation which contains not more than one (1) drachm of paregoric\n\nper thirty (30) milliliters.\n\n3. The medicinal preparation, or the liniment, ointment, or\n\nother preparation susceptible of external use only, prescribed,\n\nadministered, dispensed, or distributed, shall contain, in addition\n\nto the narcotic drug in it, some drug or drugs conferring upon it\n\nmedicinal qualities other than those possessed by the narcotic drug\n\nalone. Such preparation shall be prescribed, administered,\n\ndispensed, and distributed in good faith as a medicine, and not for\n\nthe purpose of evading the provisions of this act.\n\n4. The provisions of Section 2-314 of this act shall apply to\n\nthe preparations referred to in subsection A of this section.\n\nNothing in this section shall be construed to limit the kind and\n\nquantity of any narcotic drug that may be prescribed, administered,\n\ndispensed, or distributed to any person or for the use of any person\n\nor animal when it is prescribed, administered, dispensed, or\n\ndistributed in compliance with the general provisions of this act.","path":["OK Code","Title 63"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os63.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"fb9ad76ba9dac006ddb773c35ae07ea714b15c73f5b6b21741c835027edc3b57","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-63-63-2-312v2","next":"us-ok/okla.-stat.-tit.-63-63-2-314"},"notice":"GroundRules: Original legal text.
