No person shall use tincture of opium, tincture of opium\n\ncamphorated, or any derivative thereof, by the hypodermic method,\n\neither with or without a medical prescription therefor.\n\nB. No person shall use drug paraphernalia to plant, propagate,\n\ncultivate, grow, harvest, manufacture, compound, convert, produce,\n\nprocess, prepare, test, analyze, pack, repack, store, contain,\n\nconceal, inject, ingest, inhale or otherwise introduce into the\n\nhuman body a controlled dangerous substance in violation of the\n\nUniform Controlled Dangerous Substances Act, except those persons\n\nholding an unrevoked license in the professions of podiatry,\n\ndentistry, medicine, nursing, optometry, osteopathy, veterinary\n\nmedicine or pharmacy.\n\nC. No person shall deliver, sell, possess or manufacture drug\n\nparaphernalia knowing, or under circumstances where one reasonably\n\nshould know, that it will be used to plant, propagate, cultivate,\n\ngrow, harvest, manufacture, compound, convert, produce, process,\n\nprepare, test, analyze, pack, repack, store, contain, conceal,\n\ninject, ingest, inhale or otherwise introduce into the human body a\n\ncontrolled dangerous substance in violation of the Uniform\n\nControlled Dangerous Substances Act.\n\nD. Any person eighteen (18) years of age or over who violates\n\nsubsection C of this section by delivering or selling drug\n\nparaphernalia to a person under eighteen (18) years of age shall,\n\nupon conviction, be guilty of a Class D3 felony offense and shall be\n\npunished by imprisonment as provided for in subsections B through F\n\nof Section 20P of Title 21 of the Oklahoma Statutes.\n\nE. Any person who violates subsections A, B or C of this\n\nsection shall, upon conviction, be guilty of a misdemeanor\n\npunishable as follows:\n\n1. For a first offense the person shall be punished by\n\nimprisonment in the county jail for not more than one (1) year or by\n\na fine of not more than One Thousand Dollars ($1,000.00), or both\n\nsuch fine and imprisonment;\n\n2. For a second offense the person shall be punished by\n\nimprisonment in the county jail for not more than one (1) year or by\n\na fine of not more than Five Thousand Dollars ($5,000.00), or both\n\nsuch fine and imprisonment; and\n\n3. For a third or subsequent offense the person shall be\n\npunished by imprisonment in the county jail for not more than one\n\n(1) year or by a fine of not more than Ten Thousand Dollars\n\n($10,000.00), or both such fine and imprisonment.\n\nF.
