Stat. tit. 63, § 63-2-407.1","heading":"Certain substances causing intoxication, distortion or","body":"disturbances of auditory, visual, muscular or mental processes\n\nprohibited - Exemptions - Penalties.\n\nA. For the purpose of inducing intoxication or distortion or\n\ndisturbance of the auditory, visual, muscular, or mental process, no\n\nperson shall ingest, use, or possess any compound, liquid, or\n\nchemical which contains ethylchloride, butyl nitrite, isobutyl\n\nnitrite, secondary butyl nitrite, tertiary butyl nitrite, amyl\n\nnitrite, isopropyl nitrite, isopentyl nitrite, or mixtures\n\ncontaining butyl nitrite, isobutyl nitrite, secondary butyl nitrite,\n\ntertiary butyl nitrite, amyl nitrite, isopropyl nitrite, isopentyl\n\nnitrite, or any of their esters, isomers, or analogues, or any other\n\nsimilar compound.\n\nB. No person shall possess, buy, sell, or otherwise transfer\n\nany substance specified in subsection A of this section for the\n\npurpose of inducing or aiding any other person to inhale or ingest\n\nsuch substance or otherwise violate the provisions of this section.\n\nC. The provisions of subsections A and B of this section shall\n\nnot apply to:\n\n1. The possession and use of a substance specified in\n\nsubsection A of this section which is used as part of the care or\n\ntreatment by a licensed physician of a disease, condition or injury\n\nor pursuant to a prescription of a licensed physician; and\n\n2. The possession of a substance specified in subsection A of\n\nthis section which is used as part of a known manufacturing process\n\nor industrial operation when the possessor has obtained a permit\n\nfrom the State Department of Health.\n\nD. The State Board of Health shall promulgate rules and\n\nregulations establishing procedures for the application, form and\n\nissuance of a permit to legitimate manufacturing and industrial\n\napplicants as provided for in subsection C of this section.\n\nE. Any person convicted of violating any provision of\n\nsubsection A or B of this section shall be guilty of a misdemeanor\n\npunishable by imprisonment in the county jail not to exceed ninety\n\n(90) days or by the imposition of a fine not to exceed Five Hundred\n\nDollars ($500.00), or by both such imprisonment and fine. Each\n\nviolation shall be considered a separate offense.\n\nF.
