Stat. tit. 63, § 63-2-422","heading":"Definitions","body":"As used in the Drug Dealer Liability Act:\n\n1. \"Illegal drug\" means a drug whose distribution is a\n\nviolation of state law;\n\n2. \"Illegal drug market\" means the support system of illegal\n\ndrug-related operations, from production to retail sales, through\n\nwhich an illegal drug reaches the user;\n\n3. \"Illegal drug market target community\" is the area described\n\nunder Section 7 of this act;\n\n4. \"Individual drug user\" means the individual whose illegal\n\ndrug use is the basis of an action brought under this act;\n\n5. \"Level one offense\" means possession of one quarter (1/4)\n\nounce or more, but less than four (4) ounces, or distribution of\n\nless than one (1) ounce of a specified illegal drug, or possession\n\nof one (1) pound or twenty-five plants or more, but less than four\n\n(4) pounds or fifty plants, or distribution of less than one (1)\n\npound of marijuana;\n\n6. \"Level two offense\" means possession of four (4) ounces or\n\nmore, but less than eight (8) ounces, or distribution of one (1)\n\nounce or more, but less than two (2) ounces, of a specified illegal\n\ndrug, or possession of four (4) pounds or more or fifty plants or\n\nmore, but less than eight (8) pounds or seventy-five plants, or\n\ndistribution of more than one (1) pound but less than ten (10)\n\npounds of marijuana;\n\n7. \"Level three offense\" means possession of eight (8) ounces\n\nor more, but less than sixteen (16) ounces, or distribution of two\n\n(2) ounces or more, but less than four (4) ounces, of a specified\n\nillegal drug or possession of eight (8) pounds or more or seventy-\n\nfive plants or more, but less than sixteen (16) pounds or one\n\nhundred plants, or distribution of more than five (5) pounds but\n\nless than ten (10) pounds of marijuana;\n\n8. \"Level four offense\" means possession of sixteen (16) ounces\n\nor more or distribution of four (4) ounces or more of a specified\n\nillegal drug or possession of sixteen (16) pounds or more or one\n\nhundred plants or more or distribution of ten (10) pounds or more of\n\nmarijuana;\n\n9. \"Participate in the illegal drug market\" means to\n\ndistribute, possess with an intent to distribute, commit an act\n\nintended to facilitate the marketing or distribution of, or agree to\n\ndistribute, possess with an intent to distribute, or commit an act\n\nintended to facilitate the marketing and distribution of an illegal\n\ndrug. \"Participate in the illegal drug market\" does not include the\n\npurchase or receipt of an illegal drug for personal use only;\n\n10. \"Person\" means an individual, a governmental entity,\n\ncorporation, firm, trust, partnership, or incorporated or\n\nunincorporated association, existing under or authorized by the laws\n\nof this state, another state, or a foreign country;\n\n11. \"Period of illegal drug use\" means, in relation to the\n\nindividual drug user, the time of first use by an individual of an\n\nillegal drug to the accrual of the cause of action. The period of\n\nillegal drug use is presumed to commence two (2) years before the\n\ncause of action accrues unless the defendant proves otherwise by\n\nclear and convincing evidence;\n\n12. \"Place of illegal drug activity\" means, in relation to the\n\nindividual drug user, each county in which the individual possesses\n\nor uses an illegal drug or in which the individual resides, attends\n\nschool, or is employed during the period of the illegal drug use of\n\nthe individual, unless the defendant proves otherwise by clear and\n\nconvincing evidence;\n\n13. \"Place of participation\" means, in relation to a defendant\n\nin an action brought under the Drug Dealer Liability Act, each\n\ncounty in which the person participates in the illegal drug market\n\nor in which the person resides, attends school, or is employed\n\nduring the period of the participation in the illegal drug market by\n\nthe person; and\n\n14. \"Specified illegal drug\" means cocaine, heroin, or\n\nmethamphetamine and any other drug the distribution of which is a\n\nviolation of state law.","path":["OK Code","Title 63"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os63.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"9523d24e2645648f8ad1df7777b0d48e04fe285092c28d73d99194a529423719","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-63-63-2-421","next":"us-ok/okla.-stat.-tit.-63-63-2-423"},"notice":"GroundRules: Original legal text.
