Stat. tit. 63, § 63-2-424","heading":"Persons who may bring action - Persons liable - Damages","body":"recoverable.\n\nA. One or more of the following persons may bring an action for\n\ndamages caused by use of an illegal drug by an individual:\n\n1. A parent, legal guardian, child, spouse, or sibling of the\n\nindividual drug user;\n\n2. An individual who was exposed to an illegal drug in utero;\n\n3. An employer of the individual drug user; and\n\n4. A medical facility, insurer, governmental entity, employer,\n\nor other entity that funds a drug treatment program or employee\n\nassistance program for the individual drug user or that otherwise\n\nexpended money on behalf of the individual drug user.\n\nB. A person entitled to bring an action under this section may\n\nseek damages from one or more of the following:\n\n1. A person who knowingly distributed, or knowingly\n\nparticipated in the chain of distribution of, an illegal drug that\n\nwas actually used by the individual drug user;\n\n2. A person who knowingly participated in the illegal drug\n\nmarket if:\n\na. the place of the illegal drug activity by the\n\nindividual drug user is within the illegal drug market\n\ntarget community of the defendant,\n\nb. the participation of the defendant in the illegal drug\n\nmarket was connected with the same type of illegal\n\ndrug used by the individual user, and\n\nc. the defendant participated in the illegal drug market\n\nat any time during the illegal drug use of the\n\nindividual user.\n\nC. A person entitled to bring an action under this section may\n\nrecover all of the following damages:\n\n1. Economic damages including, but not limited to, the cost of\n\ntreatment and rehabilitation, medical expenses, loss of economic or\n\neducational potential, loss of productivity, absenteeism, support\n\nexpenses, accidents or injury, and any other pecuniary loss\n\nproximately caused by the illegal drug use;\n\n2. Noneconomic damages, including, but not limited to, physical\n\nand emotional pain, suffering, physical impairment, emotional\n\ndistress, mental anguish, disfigurement, loss of enjoyment, loss of\n\ncompanionship, services and consortium, and other nonpecuniary\n\nlosses proximately caused by an individual's use of an illegal drug;\n\n3. Exemplary damages;\n\n4. Reasonable attorney fees; and\n\n5.
