Stat. tit. 63, § 63-2-425","heading":"Individual drug users who may bring action - Persons","body":"liable for damages - Damages recoverable.\n\nA. An individual drug user shall not bring an action for\n\ndamages caused by the use of an illegal drug, except as otherwise\n\nprovided in this subsection. An individual drug user may bring an\n\naction for damages caused by the use of an illegal drug only if all\n\nof the following conditions are met:\n\n1. The individual personally discloses to narcotics enforcement\n\nauthorities, more than six (6) months before filing the action, all\n\nthe information known to the individual regarding their source of\n\nillegal drugs;\n\n2. The individual has not used an illegal drug within the six\n\n(6) months before filing the action; and\n\n3. The individual continues to remain free of the use of an\n\nillegal drug throughout the pendency of the action.\n\nB. A person entitled to bring an action under this section may\n\nseek damages only from a person who distributed, or is in the chain\n\nof distribution of, an illegal drug that was actually used by the\n\nindividual drug user.\n\nC. A person entitled to bring an action under this section may\n\nrecover only the following damages:\n\n1. Economic damages, including but not limited to the cost of\n\ntreatment, rehabilitation, and medical expenses, loss of economic or\n\neducational potential, loss of productivity, absenteeism, accidents\n\nor injury, and other pecuniary loss proximately caused by the\n\nperson's illegal drug use;\n\n2. Reasonable attorney fees; and\n\n3.
