An action by an individual drug user is governed by the\n\nprinciples of comparative responsibility. Comparative\n\nresponsibility attributed to the plaintiff does not bar recovery but\n\ndiminishes the award of compensatory damages proportionally,\n\naccording to the measure of responsibility attributed to the\n\nplaintiff.\n\nB. The burden of proving the comparative responsibility of the\n\nplaintiff is on the defendant, which shall be shown by clear and\n\nconvincing evidence.\n\nC.
