Subject to the availability of funds, each district attorney\n\nmay create within the office of the district attorney a Drug\n\nPossession Diversion Program and assign sufficient staff and\n\nresources for the efficient operation of the program.\n\nB. Referral of a violation of the provisions of Section 2-402\n\nof Title 63 of the Oklahoma Statutes or possession of drug\n\nparaphernalia in violation of subsection B of Section 2-405 of Title\n\n63 of the Oklahoma Statutes to the Drug Possession Diversion Program\n\nshall be at the discretion of the district attorney. This act shall\n\nnot limit the power of the district attorney to prosecute a case for\n\npossession of a controlled dangerous substance.\n\nC. Upon receipt of a case for possession of a controlled\n\ndangerous substance, the district attorney shall determine if the\n\ncharge is one which is appropriate to be referred to the Drug\n\nPossession Diversion Program.\n\nD. In determining whether to refer a case to the Drug\n\nPossession Diversion Program, the district attorney shall consider\n\nthe following:\n\n1. The schedule of the controlled dangerous substance possessed\n\nby the defendant;\n\n2. The amount of the controlled dangerous substance possessed\n\nby the defendant;\n\n3. If the defendant has a prior criminal record;\n\n4. The number of drug-related crimes against the defendant\n\npreviously received by the district attorney;\n\n5. Whether or not there are other criminal charges currently\n\npending against the defendant; and\n\n6.
