Stat. tit. 63, § 63-2151.1","heading":"Organ and tissue donations from HIV positive persons","body":"No reproductive tissue(s) shall be procured for donation\n\npurposes from any person testing positive for the human\n\nimmunodeficiency virus (HIV) infection. Organ(s) and tissue(s) may\n\nbe procured for donation purposes from any person testing positive\n\nfor HIV infection, provided such procurement and donation are\n\nconsistent with the HIV Organ Policy Equity (HOPE) Act (P.L. 113-51,\n\n127 Stat. 579 (2013)) and the regulations promulgated thereunder by\n\nthe Organ Procurement and Transplantation Network and the United\n\nStates Food and Drug Administration.\n\n1. Every donor, donor candidate or tissue(s) or organ(s) to be\n\ndonated shall be tested for the virus infection immediately prior to\n\nthe donation of reproductive tissue(s) or tissue(s) or organ(s) for\n\ntransplant. If such test has not been conducted immediately prior\n\nto the donation, then the test shall be conducted immediately prior\n\nto the implantation of the donor organ(s) or tissue(s).\n\n2. If the donor is living, the donor shall be notified of the\n\ntest results. Notification shall be consistent with donor\n\nconfidentiality and with the requirements of state and federal law.\n\nThe hospital or other facility responsible for the reproductive\n\ntissue, tissue or organ donation shall provide directly or otherwise\n\nmake available appropriate information and counseling services to\n\nreproductive tissue donors and to living tissue or organ donors.","path":["OK Code","Title 63"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os63.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"b6753417fefcdb259a23dc4a96270b83c17a7fd368f8bf40071c1fc64631ba8b","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-63-63-2151","next":"us-ok/okla.-stat.-tit.-63-63-2152"},"notice":"GroundRules: Original legal text.
