Stat. tit. 63, § 63-2175","heading":"Public umbilical cord blood bank – Education program –","body":"Donation to bank.\n\nA. Contingent on the provision of appropriated funds designated\n\nfor the State Department of Health or the donation of private funds\n\nto the State Department of Health for such purpose, on or before\n\nJanuary 1, 2009, the State Department of Health, in collaboration\n\nwith a private blood donor or private blood bank organization, shall\n\nestablish, operate and maintain a public umbilical cord blood bank\n\nor cord blood collection operation for the purpose of collecting and\n\nstoring umbilical cord blood and placental tissue donated by\n\nmaternity patients at hospitals licensed in this state.\n\nB. On or before January 1, 2009, the State Department of\n\nHealth, in collaboration with a private blood donor or private blood\n\nbank organization shall establish a program to educate maternity\n\npatients with respect to the subject of cord blood banking. The\n\nprogram shall provide maternity patients with sufficient information\n\nto make an informed decision on whether or not to participate in a\n\nprivate or public umbilical cord blood banking program and shall\n\ninclude, but not be limited to, explanations and information on:\n\n1. The difference between public and private umbilical cord\n\nblood banking;\n\n2. The medical process involved in umbilical cord blood\n\nbanking;\n\n3. The current and potential future medical uses of stored\n\numbilical cord blood;\n\n4. The benefits and risks involved in banking umbilical cord\n\nblood; and\n\n5. The availability and cost of storing umbilical cord blood\n\nand placental tissue in public and private umbilical cord blood\n\nbanks.\n\nC. 1. Each physician licensed in this state and each hospital\n\nlicensed in this state shall inform each pregnant patient under the\n\ncare of the physician or hospital, not later than thirty (30) days\n\nfrom the commencement of the patient’s third trimester of pregnancy,\n\nof the opportunity to donate to the public umbilical cord blood\n\nbank, established under subsection A of this section, blood and\n\ntissue extracted from the umbilical cord and placenta, following\n\ndelivery of a newborn child, at no cost to the patient.\n\n2. Nothing in this section shall be construed to:\n\na. obligate a hospital to collect umbilical cord blood or\n\nplacental tissue if, in the professional judgment of a\n\nphysician licensed in this state, the collection would\n\nthreaten the health of the mother or child,\n\nb. prohibit a maternity patient from donating or storing\n\nblood extracted from the umbilical cord or placenta of\n\nthe patient’s newborn child to a private umbilical\n\ncord blood and placental tissue bank, or\n\nc. impose a requirement upon attending medical personnel\n\nwho object to umbilical cord blood or placental tissue\n\ndonation as being in conflict with their religious\n\ntenets and practice.","path":["OK Code","Title 63"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os63.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"e8fab9d1c8cb7c65d736d6c25855f397d810ae44b858ab7e6be5e2db0d1cfa90","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-63-63-2173","next":"us-ok/okla.-stat.-tit.-63-63-2175.1"},"notice":"GroundRules: Original legal text.
